On Monday, the list of legislative and program works of the government published the assumptions of the draft amendment to the Act on supporting the development of telecommunications services and networks (so -called megarest) and some other acts by the Ministry of Digitization.

As indicated in the description of the assumptions, the main purpose of the planned novel is to enable the use of the so -called GIA regulation. It is about the EU regulation of April 2024 regarding funds aimed at reducing the costs of implementing gigabit electronic communication networks. The provisions of this regulation are aimed at accelerating, simplifying and reducing the costs of implementing stationary and wireless networks with very high bandwidth throughout the EU. This is to be possible, among others by appropriate planning, improved coordination and introduction of simplified and digital procedures for granting permits to reduce administrative burdens resting on national operators and administration.

According to the assumptions of the draft, the amendment to the megaust is to introduce the obligation to equip single -family buildings with fiber optic infrastructure. At the same time, however, exceptions to protect monuments are to be introduced. As noted in the list, the GIA regulation requires that from February 12, 2026, new or thorough renovation buildings were equipped with fiber optic infrastructure. The project is also to introduce the obligation to attach a declaration of telecommunications installations on the collection of buildings.

The change of megah also has, among others contain new definitions and adapt and unify existing ones to ensure compliance, consistency and practical enforceability of the GIA regulation. It is also to extend the circle of entities obliged to provide technical infrastructure and information about it, introduce changes to the electronic communication procedure conducted by the President of the Office for access to technical infrastructure. It comes, among others for resignation from arrangements with the President of the Energy Regulatory Office and the Office of Railway Transport and at the same time shortening up to 30 days of duration of administrative proceedings.

In addition, the amendment is to extend the functionality of the UKE information point to make it easier to conclude contracts for access to the data contained in it and enable electronic access to information.

The maximum rate for placing telecommunications infrastructure in internal roads is also to be determined and other simplifications and improvements of the investment process for the implementation of a very high capacity network are to be added.

Some of the changes designed as part of the amendment are to be introduced in the Public Roads Act, traffic law and electronic communication law. As part of the amendment, deregulation changes are to be implemented, including the obligation to report a telecommunications infrastructure based on copper and data on the course of optical fibers in the existing cable sewage system.

As explained in the description of the assumptions for the project, despite the direct application of the GIA regulation in the EU countries, its provisions “do not exhaust all regulatory aspects and do not provide full harmonization in the implementation of telecommunications infrastructure.” In addition, the Member States have been left to some freedom in the field of institutional and organizational framework and the use of inclusion provided for in the GIA regulation.

The planned date for the project adopting by the government is the last quarter of this year. (PAP)
