A few years before the collapse of the Cinkciarz.pl online currency exchange office, ZUS received a request to initiate control proceedings in the company. The notification concerned the “apparent employment” of the wife of President Marcin P. – Roxana K.-P., whose goal was to receive high benefits from ZUS.
The case was the first to publicize “TOK FM”, which reached the correspondence between the signalist and the office. According to the application, which went to the ZUS branch in Zielona Góra, Roxana K.-P. “While becoming a second pregnancy, she was fictitious with a very high salary to extort her benefits during maternity and parental leave.”
In the document, which was reached by the editors of “TOK FM”, it was appealed for ZUS to appear in this case as a public prosecutor, because Up to several hundred thousand zlotys could have come into play, which according to the guide should be returned to the Treasury by Marcin P. and his wife Roxana.
The signalist indicated that Roxana K.-P. She did not perform any official duties, did not come to the office and knows nothing about the functioning of the company.

The application for the initiation of proceedings by ZUS was also to include a list of employees who should be questioned to find out what the activities of K.-P.
ZUS washes his hands
ZUS in Zielona Góra refused to initiate proceedings. As justified in the letter, which was reached by the editors of “TOK FM”, the author of the complaint was not a party to the proceedings and did not make his legal interest credible, and according to the provisions, administrative proceedings are initiated either ex officio or at the request of a party.
ZUS also stated that he had “analyzed the likelihood of violation of the law by the contribution payer” (cinkciarz.pl), but he did not find premises to initiate the proceedings. – ZUS has not only competence, but also the obligation to properly control the benefits paid. In this context, it is incomprehensible to the lack of response from ZUS officials to notification of possible irregularities in employment in the company – believes patron Kamil Zwonka.
Journalists “TOK FM” wanted to find out whether “Analysis of the probability of violation”, which was mentioned by ZUS, means that the office carried out an inspection in the company. This, however, refused to answer, citing the provisions saying that information on the data contained on the individual account of the insured may only provide with the written consent of Roxana K. – P.
– In fact, ZUS does not want to provide public information what actions he took in this matter and how these actions have ended – comments Kamil Zwonka and adds that we only have speculation. The legal advisor points out that ZUS in many cases undermines employment and demands a return of benefits, but in practice it often turns out that the return of benefits has expired.

The prosecutor's office refuses
In January 2023, the fictitious employment of the wife of the president of Cinkciarz.pl was reported to the ZUS headquarters, the Central Anti -Corruption Bureau, the Prosecutor General Prosecutor's Office and the Ministry of Family and Social Policy. The complaint was forwarded to the District Prosecutor's Office in Zielona Góra, which in March 2023 refused to initiate an investigationexplaining that the behavior of ZUS officials was lawful because they carried out inspections at Cinkciarz.pl in 2015 and 2022 and did not notice the irregularities regarding the application.
Roxana K. – P. was reported to social insurance as an employee of the company since the beginning of November 2012, and The total amount of the benefits she collected, mainly maternity and guardianship benefits, was PLN 343 005.20 throughout the entire period of employment. So she was employed by cinkciarz.pl during both inspections.
“TOK FM” heard in May 2025 from a spokeswoman for the District Prosecutor's Office in Zielona Góra that ZUS carried out an inspection in an appropriate scope and in accordance with the law. Therefore, witnesses were not questioned due to the lack of grounds to initiate proceedings.

Despite the previous declarations of the prosecutor's office, it turned out that in July 2025 she returned to the fictitious employment of the wife of the president of Cinkciarz.pl. This time she focused on alleged fraud, not the role of officials. Investigators examine whether there has been a extortion of the mentioned 343 thousand zlotys by misleading ZUS employees.
However, the situation raises doubts. As Patron Kamil Zawka notes, if ZUS has not found irregularities in this case, the prosecutor's office may be surprised. – The recognition of the contract by ZUS as an important title to insurance in practice crosses the actions of the prosecutor's office and attempts to assign the employment relationship to the signs of a crime – notes the legal advisor.
– It is worth noting that the amount of benefits seems high, but remember that the amount of benefits is associated with the amount of remuneration from the employment contract from which the contributions are paid. The prosecutor's office in Zielona Góra did not provide journalists of “TOK FM” detailed information about the case, explaining the investigation of the Regional Prosecutor's Office in Poznań.
