New rules for benefits for foreigners. What will change?


The draft act amending certain acts in order to verify the right to family benefits for foreigners and on the conditions of assistance to Ukrainian citizens in connection with the armed conflict on the territory of this country on Tuesday was published on the website of the Government Legislation Center.
It assumes the connection of the right to parental benefit (the so -called 800 plus) for foreigners from third countries with the applicant's activity in the labor market and with the teachings of children at the Polish school. In the justification, the ministry explained that the introduced provisions make the right to benefits to professional activity only the applicant and do not refer to the professional situation of the second parent or child guardian.

“This means that benefits will also be entitled to a family in which one of the parents at the expense of professional activity devotes time to raising children. However, this does not change the fact that foreigners legally staying in Poland should have the funds necessary to maintain, and family benefits should not be the only source of income” – he explained.
The processed provisions are to enable the Social Insurance Institution – in order to pay benefits or suspend them – the monthly verification in the register kept by the Chief of Border Guard Commander fulfilling the premise for living foreigners in the Republic of Poland.
In addition, the project makes the right to benefit a good start by foreigners on meeting the condition regarding professional activity or being subject to health insurance.
The draft introduces changes to the Act on population register. They consist in introducing the obligation to appear in person when granting a PESEL number, except for children who were born in Poland. This is to allow you to verify children's stay in Poland, for whom the application is submitted.
The regulations also introduce changes resulting from the EU's executive decision of June 25, 2024. They assume an extension by March 4, 2026, the period in which the stay of Ukrainian citizens in Poland, who arrived in connection with war operations conducted on the territory of this country, is considered legal and related access to the labor market. At the same time, it introduces solutions to seal the support system and eliminates some of the current extraordinary solutions.
Therefore, by March 4, 2026, an extension of the period in which the temporary use of a building object put into use, for the purposes of collective residence of Ukrainian citizens, is planned.
In addition, it extends the period of validity of the national visa of the Ukrainian citizen and the temporary residence permit granted to the Ukrainian citizen, the deadline to leave the Ukrainian citizen of the territory of the Republic of Poland and the date of the voluntary return of the Ukrainian citizen, as well as the period of validity of the residence cards, Polish identity documents of the foreigner and the documents “consent to the tolerated residence” issued to the citizens of Ukrainian.
The project assumes the extension of tax preferences constituting tax support in connection with the ongoing conflict in Ukraine by the end of 2026. It comes, among others not to include the value of donations and free benefits to revenues by taxpayers, exemptions from PIT humanitarian aid received by taxpayers who were citizens of Ukraine, who after February 23, 2022, as a result of the warfare there came from Ukraine to Poland.
In addition, the Ministry of Interior and Administration proposes to clarify issues related to keeping in the ICT system of the National set of registers, records and list in matters of foreigners. The Chief Commander of the Border Guard will be required to enter data from documents constituting the basis for crossing the border and add fingerprint prints to clearly identify people.
The project sets out the completion date for receiving war refugees from Ukraine to collective accommodation centers on October 31, 2025, except for sensitive groups. They were also specified exactly in the project. It was also clarified when the voivode can check the Ukrainian citizen from the center.
In addition, the catalog of premises to repeal a temporary residence permit for a year or 6 months would be extended in a situation where a Ukrainian citizen has submitted an application containing false personal data or false information; He testified untruth, concealed the truth or forged or converted the document to use it as an authentic or such document as an authentic; If marriage was concluded to circumvent the provisions specifying the principles and conditions of the entry of foreigners to Poland.

In the department's opinion, the proposed changes are aimed at “preventing the influx of foreigners from third countries, whose goal is mainly to persist from the benefits offered in Poland.” At the same time, they are to prevent “the risk of social exclusion of foreigners from third countries legally staying on Poland.”
Maciej Duszczyk informed about the completion of work on the bill sealing foreigners to family benefits and health care on Monday evening.

His decision was motivated by, among others The fact that the 800 plus benefit should only be given to Ukrainians who work in Poland.
The amendment to the Act vetoed by Nawrocki assumed an extension of temporary protection granted to Ukrainian citizens escaping from the war until March 4, 2026. This resulted from the EU's executive decision of June 25, 2024. In addition, it assumed actions sealing the assistance system. It was on excluding the possibility of giving the rights to Ukrainian citizens who shortly cross the border on the basis of a permit to cross the border within the part of small border traffic.
