An American federal judge has blocked the accelerated expulsion procedure of migrants in the US, based on the mass deportation plan President Donald Trump, reports Reuters and AFP on Saturday, quoted by Agerpres.

The accelerated expulsion procedure was used by the Republican administration to quickly deport the arrested migrants near the border with Mexico in the last two weeks.

However, since taking over the mandate in January, the Trump administration has generalized the application of this procedure to the whole of the country and applied to migrants who have already been on the US territory, sometimes that period reaching two years.

In a decision published on Friday night, Federal Judge Jia Cobb blocked this extended application of the procedure, arguing that it could apply “erroneously”, outside any legal procedure, to people to be expelled, especially to people who have not been able to prove that they are in the US for at least two years.

“Unlike the group of people data subject to accelerated expulsion – those who are arrested at the border shortly after passing – the category of people aimed at with this accelerated expel has entered our country for a long time,” explained Jia Cobb.

“In the defense of this expert procedure, the government advances a truly amazing argument: those who have illegally entered the country are not entitled to any procedure by virtue of the amendment 5 (of the US Constitution) and could only count on a possible measure in congress,” the judge added.

Amendment 5 of the American Constitution aims to protect individuals from any abuse of authority from the government during a legal procedure.
