The application for controlling the functioning of the National Center for Prevention of Dissoczdzoczna behavior in Gostynin (Masovian Voivodeship) and the Branch in Czersk (Pomeranian Voivodeship) to the Ministers of Health and Justice on Tuesday, among others CT judges at the rest of prof. Under the application to the Ministry of Health Jolanta Sobierańska-Grenda, Minister of Justice Waldemar Żurek, chairman of the parliamentary committee of justice and human rights Paweł Śliz, senator Marcin Karpiński, signed the judge of the Constitutional Tribunal at rest, former RPO prof. Ewa Łętowska, dr hab. Monika Płatek, former deputy of the RPO Dr. Hanna Machińska, a rest of the Constitutional Tribunal prof. Mirosław Wyrzykowski and prof. Zbigniew Lasocik.

The signatories of the application appealed for the immediate appointment of a government or state committee, which will be equipped with the competences necessary to carry out a comprehensive control of the National Center for Dold -Social behavior (KOZDD) in Gostynin and Branch in Czersk. Emphasized that The urgent application is managed in connection with the criticism that has been ongoing for years, as well as the recent reports of “gross irregularities” and in the face of the ongoing hunger strike of Kozd.

The application concerns the control of the legality of deprivation of liberty in Kozdd, possible cases of violations of human rights, the legitimacy of the application of specific medical procedures, the functioning of institutions in the administrative and organizational dimension.

“In our opinion, coordinated and decisive actions of the government and parliament are necessary, because the level of dysfunctionality Kozd crossed acceptable boundaries in a democratic legal state,” lawyers emphasized in the justification.

They noted that the abnormalities of the KOZD functioning have been signaled many times in scientific legal literature and in medical studies. Lawyers pointed out that irregularities were primarily formulated in the official NIK reports, in the speeches of the Ombudsman and the national torture prevention mechanism (KMPT). They emphasized that the European Committee for Prevention of Torture (CPT) also drew attention to serious violations of the rule of law and non -compliance with constitutional guarantees of human freedoms and rights.

According to the signatories, the letter is necessary to carry out a comprehensive inspection because the previous supervisory activities did not take into account all applications from the reports of the controlling institutions. “In what sense a new element is serious allegations formulated by patients regarding the functioning of this institution in the organizational dimension, e.g. financial issues and suspicions of nepotism,” they emphasized.

The petal informed on Monday PAP that several patients of the National Center for Prevention of Disjust's behavior continues hunger protest. A dozen or so Kozd patients in Gostynin (Masovian Voivodeship) and its branch in Czersk (Pomeranian Voivodeship) the hunger strike began on August 4. On August 12, the petal announced that some people decided to suspend the protest in connection with the hope of implementing their postulate to review the law of their stay in Kozd and the conditions of this stay. However, several people refused to stop fasting.

In August, the health ministry passed on PAP that he was planning control at the center in Gostynin, which would cover the years 2024-2025.

Health and justice departments are working on an amendment to the act regulating the activities of the KOZD in Gostynin. The changes are to cover, among others Rights and obligations of persons placed in the center, rules of their stay and procedures for receiving and control.

Kozd has been operating since 2014. Kozd in Gostynin (Masovian Voivodeship) and its branch unit in Czersk (Pomeranian Voivodeship) are units subordinate to the Ministry of Health and the ministry monitored by this, and the activities of the institution are regulated by the provisions of the Act of 22 November 2013 on proceedings against people with mental disorders posing a threat to life, health or sexual freedom of others. The court decides about placing in Gostynin on the basis of expert opinions. Pursuant to the Act, persons managed there should be subject to individual therapy. (PAP)
