Vlad Pascu was sentenced to ten years in prison, for the accident on May 2, when he drove drugged and killed two young people. 10 years is the maximum limit to which a convicted person can request conditional release, after making two thirds of the sentence.

The Constanta Court of Appeal rejected the appeals made by Vlad Pascu, Prosecutor's Office and the civil parties and thus maintained the decision from the first instance given by the Mangalia Court in January 2025.
And the prosecutors of the Prosecutor's Office attached to the Mangalia Court had challenged Vlad Pascu's conviction to 10 years in prison, invoking “the wrong individualization of the punishment for the crime provided by art.338 paragraph 1 Criminal code (leaving the place of the accident)”, according to the decision given on Thursday by the Constanta Court.
Prosecutors asked for a 10 -year, 6 months and 20 days sentence
The Prosecutor's Office stressed that Pascu's conviction is required to a punishment oriented by the maximum provided by law, as in the case of other offenses, “in relation to the real circumstances of committing it”.
Specifically, the prosecutors requested 10 years, 6 months and 20 days of imprisonment, the maximum conviction provided by law for the four offenses, after applying the reduction of the punishment limits as a result of the recognition of the facts.
When establishing the penalties, the prosecutor asked the court to consider “the concrete conditions and circumstances in which the facts that reveal a high degree of social danger were committed, respectively the fact that the defendant consumed before the steering wheel was raised at the wheel, under the influence of which he was in the group, while he was in the group, without announcing the authorities or at least the medical staff, proving real contempt for the fundamental human values, respectively the life and integrity of its fellow citizens. “
Pascu asked to be tried by the simplified procedure for recognizing the guilt, thus benefiting from a reduction of the limits of the punishments by one third.
8 months year of detention instead of 9 months
The stake of a sentence greater than ten years, required by prosecutors, is related to the moment when Vlad Pascu can request conditional release.
According to the Criminal Code, a convicted person can be released conditionally, for good behavior, if he has executed at least two thirds of the sentence when his conviction does not exceed 10 years. In other words, the year of prison has 8 months, instead of 12.
In the case of convicts with punishments over 10 years, the compulsory fraction they have to execute is three quarters of the punishment (9 months the year of detention).
With a final sentence of 10 years in the end, Vlad Pascu will be able to request the conditional release after executing 80 months (6 and a half years) from the punishment.
As he has already executed 24 months, Pascu will be able to request an exit from prison for good behavior over 4 and a half. If during detention will perform lucrative activities, they will be transformed into prison days and will be able to request conditional release even earlier than 2029.
If he had received the punishment required by the prosecutors, Pascu could request the conditional release only after performing 7 and a half years in prison.
This calculation was also invoked by Sebastian's father, one of the two young people killed in the accident, when he criticized the punishment decided by the Constanta Court of Appeal.
“I was hoping for a greater sentence, he did everything possible from his lawyers to take up to 10 years or 10 years. For good behavior, after 3 years we will see the streets,” Valentin Olariu told Digi24.
Why did he not receive the maximum penalty for escape from the accident site
The magistrates of the Constanța Court of Appeal considered that the criticisms of the Prosecutor's Office and the family related to the amount of the punishment for leaving the accident place are unfounded, stressing in the decision that the substantive court has correctly dosed the punishments, including the one for leaving the accident site.
“The Court considers that it is not necessary for the defendant to be applied a different punishment from the one to which the judge of the fund stopped nor for this crime, as long as this is equivalent to the middle of the interval provided by law. Contrary to the defense, we are not in the situation of a double sanction for the same facts, as we have been in the offense, as And with the danger of the offender, which is evaluated according to several criteria, respectively the nature and severity of the result produced or of other consequences of the crime ”, mentions the magistrates of the Constanta Court of Appeal in motivating the decision given on Thursday.
The court of appeal emphasizes that he considered in favor of Vlad Pascu that he “complied with the police/gendarmes as soon as he was acoustically and visually, without opposing any opposition and without subsequently evading the research.”
