Let's start to determine whose balcony really is? Does it really belong to the owner of the premises to which he belongs? – The balcony is part of the apartment to which it belongs, but not necessarily in full – says Magdalena Kasperczak, real estate management expert, managing director of Renalty. – It all depends on how the developer, when selling the premises, determined the legal status of this balcony in the notarial deed. Most often, balconies are simply adjacent to a given premises and remain for the sole use of the owner, which, however, does not mean that we have full freedom to what extent we can use it – he adds.

First of all, the facade is always a common part of the property, and the installation of the air conditioner is associated with interference in the facade. “Here, consent is definitely required,” says the expert. – Most often, communities solve this in such a way that they adopt resolutions on the possibility of installing air conditioning units, indicating in these resolutions very specific guidelines regarding their assembly and, above all, the owner's responsibility. The entire procedure for obtaining such a permit will also be described in such a resolution – he explains.
