The District Court in Warsaw fully dismissed a lawsuit filed by Michał Adamczyk questioning the correctness of the so -called TVP liquidation resolutions of December 27, 2023, which concerned the company's dissolution and the establishment of the liquidator – TVP said on Thursday.

“The court decided that the opening of the company's liquidation on the basis of the provisions of the CCC, and the liquidator was authorized to act on behalf of the Company. The provisions do not specify when the liquidation should be completed, and the reversibility of the liquidation process does not cross out the activities undertaken earlier” – it was indicated in the information provided on Thursday by the Corporate Communication Department of Polish Television.

In the oral justification of the judgment, the District Court (XXVI Economic Department) clearly stated that “the liquidation of the company was entered in the register, there are no two centers of the company's power.” “In the light of the above plaintiff (M. Adamczyk), the ID did not be entitled to submit a claim in the present case. The judgment is not final” – added on TVP.

On December 19, 2023, the then head of the Ministry of Culture and National Heritage Bartłomiej Sienkiewicz dismissed the current presidents of the management boards of Polish Television, Polish Radio and the Polish Press Agency and their supervisory board, citing the Code of Commercial Companies. He also appointed new supervisory boards of companies, which in turn selected new management boards of these companies. Tomasz Sygut became the president of the TVP board appointed by the company's supervisory board. Michał Adamczyk appointed the National Media Council in the then composition on December 26, 2023.

After Metter by President Andrzej Duda, prepared by the new government of the Okłudżetowa Act on December 27, 2023, Sienkiewicz decided to erect TVP, Polish Radio and PAP in a state of liquidation. The written justification for the judgment at the time indicated, among others, that “in the absence of proper regulation, the defendant company's situation had to be applied to the relevant commercial law: owners of joint -stock companies – public radio and television – are in relation to the appointment and dismissal of members of their supervisory boards and boards in the event of a legal gap, resulting from the lack of a solution in accordance with the Constitution of the Republic of Poland. The treasury should be obliged to make decisions enabling the proper functioning of the company and the implementation of the tasks entrusted to it.

“Michał Adamczyk is not actively legitimate to appeal the resolutions adopted on December 19, 2023: the National Media Council is not rooted in the Act in accordance with the Constitution of the Republic of Poland to appoint members of supervisory boards and public television management boards. The resolution adopted on December 26, 2023 did not have the effect of establishing the plaintiff for the position of the President of the Board of Polish + SA” – summed up the court. (PAP)
