The Senate of Romania has adopted a legislative initiative that eliminates the obligation of the holographic signature, on each page, on the documents filed in court.

The Senate of Romania has adopted, with a significant majority (111 votes for, no vote against 9 abstentions) the legislative project that concerns an essential modification in the practice of the courts: the documents “in accordance with the original” will be transmitted digitally, with electronic signature, without requiring any physical signature on each page.

So far, the Civil Procedure Code allowed only the submission of manually legalized children, with the mention “according to the original” written by the hand and a holograph on each page. An outdated bureaucratic practice, which involved useless consumption of time and resources for citizens, lawyers and courts alike.

“We digitize the civil process for good. We take a first step to get rid of the unnecessary signatures and formalities. The documents you use in court no longer have to be signed on each page and written the mention” according to the original “. The electronic sending of the acts signed electronically will be sufficient”, explained USR deputy Alex Dimitriu, lawyer and secretary of the constitutionality commission in the Chamber of Deputies, but also one of the initiators of the legislative project.

The initiative comes in the context of the efforts to modernize the judicial system, supported by investments from the National Plan of Redress and Resility (PNRR), and the proposed legislative modification is aligned with these objectives and addresses a real efficiency need, according to a USR statement.

“The resistance to the new is defeated by removing the legislative barriers. If a judicial approach is communicated by e-mail, together with the acts on which it is based, the electronic signature will produce effects of assuming the content of all acts, without the need for other formalities. And people get rid of a road and time,” said Oana Murariu, USR deputy, lawyer and member of the Legal Commission in the Chamber of Deputies.

The initiative will be transmitted to the Chamber of Deputies, which is the decision -making forum. If the project will also pass this last vote, the new regulation will lead to the disappearance of the obligation of the holographic signature and the mention “according to the original” on each page of the acts submitted in court, the significant reduction of the bureaucracy in the civil procedures, but also to the time and money savings for citizens and professionals in the legal field.
