Everywhere where there are doubts, the voices should be converted, no matter how much the peripheral committees would go – believes Prime Minister Donald Tusk. He also expects every justified electoral protest of the Supreme Court to transfer to the prosecutor's office, which will be able to check what was happening in the committees.


At the Friday conference, the prime minister was asked, among others Is it necessary to convert votes cast in the presidential election in connection with a large number of electoral protests.
Tusk said that when citizens have doubts, you have to do everything to explain them. He assured that he has no assumption that: “we count, count, maybe the election would be annulled.”
“This is not really the point. But these choices will not be important from the citizens' point of view, if we do not explain all these protests,” he added.
The head of government recalled the example of two peripheral electoral commissions in Bielsko -Biała, in which irregularities occurred – in one the votes cast for candidates were replaced, which led to the assumption that Karol Nawrocki obtained a larger number of votes in this region; In the second 160 votes cast for Trzaskowski, Nawrocki was placed in a package with voices assigned. In connection with the protests brought, the Supreme Court decided to inspect cards from a total of 13 peripheral election committees.
“We currently have a preliminary assessment of the situation in 800 committees, where there are surprising results and where the statistics clearly says that something is wrong” – said the prime minister. According to him, the Supreme Court rather “secret the results of checking procedures”, but – as he said – “wherever the counting of voices is counting, you can see that” it came, we do not know what scale, either to manipulation, or forgery or mistakes. “
Tusk: Citizens have the right to know
During the conference, Tusk noted that he could not and has no intention of issuing orders or recommendations to courts, but in the scope of government responsibility there is the work of the prosecutor's office. “The task of the prosecutor's office is not to question the result of the election, but wherever there is a suspicion of committing a forgery and crime, it will check and chase this type of event,” said the head of government.
He added that he expected that in each case, when the protest has any justification, the Supreme Court would send him to the prosecutor's office so that this “can check what was happening in the committees and that where the slightest doubt arises – to convert voices”. “Everywhere where there is doubt – yes, we count the votes again. Is it 13 committees, whether it is 800 committees, whether it is 15,000 committees,” said the prime minister.
He informed that for now the prosecutor's office has received about 150-160 protests from the Supreme Court. “We are still waiting for these protests to be handed over to honestly assess where to check and where you do not need” – he added.
He emphasized that the right of citizens to submit a protest results from the constitution, and the authorities appointed to assess the course of elections are required to examine all protests with respect and determination. He also noted that it cannot be assumed in advance that the elections are important or invalid, first you need to check the protests. “It cannot be that anyone in Poland has doubts whether his voice matters,” said Tusk.
Also in the later post on Platform X, the head of government pointed out that – according to the Constitution – the voter has the right to report to the Supreme Court a protest against the validity of the president's election. “The court's duty is to check each protest and recalculate the votes in every doubtful case. End of dot” – wrote the prime minister.

During the conference, Tusk was also asked about the possible questioning of the election result, if the Chamber of Extraordinary Control and Public Affairs of the Supreme Court decides about their validity. The prime minister stated that this chamber did not work legally. “Is there any idea, how to solve it? Not to solve it? – Prime Minister. He reminded that President Andrzej Duda vetoed the law according to which the Supreme Court composed of 15 oldest judges would decide on the validity of the election of the president in 2025.
Therefore, he appealed to the president to withdraw the veto. “Mr. President, please withdraw the veto. This will mean that tomorrow we will have Supreme Court judges, whose decisions we will all accept,” said Tusk.
The Chamber of Control Extremely and Public Affairs – which, according to the Supreme Court Act, is suitable for, among others deciding on the validity of the election – consists of judges appointed as a result of procedures before the National Court Register after 2017. For this reason, the status of the Chamber is questioned by the current government, which recalls, among others Jurisprudence of the Court of Justice of the EU and the European Court of Human Rights. Before 2018, the election issues were considered by the then Insurance and Public Affairs Chamber.
In January this year, the Sejm adopted the so -called Incidental Act, according to which the validity of, among others The election of the president in 2025 would state “the Supreme Court composed of 15 judges of the oldest service as a SN judge”, and not – the Chamber of Extraordinary Control and Public Affairs. However, the president vetoed this law.
After examining all protests, based on the report on the election presented by the PKW, the Supreme Court, in the composition of the entire Chamber of Extraordinary Control and Public Affairs, decides on the validity of the election of the President of the Republic of Poland. The resolution in this matter is collapsed within 30 days of making the results of the choice to the public. This means that the last day that this decision should be made is July 2 this year.
SN spokesman Judge Aleksander Stępkowski told PAP on Friday that he does not rule out that the number of protests against the election of the President of the Republic of Poland would exceed the scale of 50,000. He added that the date of the meeting of the Chamber of Extraordinary Control in this matter has not been set yet. “However, we intend to keep this deadline until July 2, although at a scale of 50,000 protests it is a huge undertaking,” he said.
