General spokeswoman Juliane Kokott proposed on Thursday to dismiss the appeal lodged by Google in the case of Android. In her opinion, the EU court decision and a fine of EUR 4.125 billion for abuse of the dominant position on the market should be upheld.


The case concerns the decision of the European Commission of 2018, in which it was stated that Google imposed on manufacturers of devices and operators of mobile networks anti -competitive license conditions regarding the use of the Android system and the Play Store store. It was For the obligatory pre -installation of Google Search search engine and Chrome browser as a condition for access to the application store.
The Commission considered this to be contrary to EU law and imposed a fine of EUR 4.343 billion on the company. In 2022, the EU court partially annulled the commission's decision and reduced the fine to EUR 4.125 billion. Google appealed against this decision.
In the opinion issued on Thursday, Kokott decided that the EU Court correctly assessed the allegations and evidence, and the legal arguments of the American concern did not undermine the findings. She emphasized that the pre -installation of the Google application had a real impact on users' decisions and made it difficult to enter the market.
The opinion of the general spokesman is not binding, but in many cases the Tribunal follows her. The Google judgment is expected in the coming months.
