

Participants in the Ukrainian wind-energy association (UVEA), the European-Ukrainian Energy Agency (EUEA), the Ukrainian Association of renewable energy (UAVE) and the Solar Energy Association of Ukraine (ASEU) turned to the Ministry of Energy of Ukraine, NKREKU and the Secretariat of the Energy Community with proposals to solve the problem of debt in the field of electricity generation from the generation of electricity renewable sources (VIE).
Investors ask the NKREKU to resolve the debt to reimburse the cost of resolving non-balance of electricity produced from VIE, from January 15, 2021 to September 8, 2022, the agency noted.
The initiators of the appeal indicate that the problem concerns the illegal application of the formula approved by the NKREKU Decree No. 46 of January 15, 2021. This formula, the letter says, was recognized as the Supreme Court of Ukraine unlawful.
“Investors called on the regulator to recognize the illegality of the formula, which acted until the court decision of September 8, 2022, and at the same time return to the formula that acted until January 15, 2021. In their opinion, the commission may apply a new order approved by the NKREKU No. 178, 2012, as an alternative option to resolve the problem of non -balance,” he informs “RBC-Ukraine”.
Investors invited NKREKU to hold a joint meeting with their participation and GP “Guaranteed Buyer” in order to coordinate the formula for calculating non -balances based on court decisions, to determine the deadline for recalculating the debt of GP “Guaranteed buyer”, as well as develop a mechanism for repayment of debt to producers of “green” electricity.
“The operational and fair settlement of the situation with the reimbursement of the value of the cost of resolving non -balance of electricity” guaranteed buyer “is critical to stabilize renewable renewals in Ukraine, protect the rights and legitimate interests of renewal producers, as well as to ensure the trust of investors to the industry,” the association participants emphasized.
Context
As of the end of April 2025 Debt of NEK “Ukrenergo” Before the “Guaranteed Buyer” enterprise for the service to increase “green” electricity amounted to UAH 16.3 billion. The level of payment for electricity made in 2024 is now 88.3%. At the same time, the calculation for 2022 is only 63.9%.
