Hundreds of protests have already received the Supreme Court against the president's election

So far, 434 protests have been received by the Supreme Court against the president's election – Monika Drwal from the press team of the Supreme Court informed PAP on Friday. There is time until Monday, June 16 to submit such protests.


As previously informed, the Supreme Court in some protests are raised, among others Irregularities in preparing voting reports and when counting votes in some election committees. On Thursday, it was reported that the Supreme Court ordered the conversion of votes from 13 regional electoral commissions. The Supreme Court decided to take this proof “by court assistance by competent district courts” – he was noted.
“In this ordinance, the taking of the evidence was determined as very urgent. For recalculation of votes in these committees and providing information to the Supreme Court, up to seven days is designated to the Supreme Court, but it is possible that we will receive information faster” – said the lumberjack on Friday PAP.
Time for submitting to the Supreme Court protests against the president's election began after the state election commission was made public by the result of the election and announcement of the election of Karol Nawrocki. Until now, and therefore until Friday in the afternoon, 434 election protests were received by the Supreme Court. The Chamber of Extraordinary Control and Public Affairs of the Supreme Court has already dealt with 22 of them. Most, i.e. a dozen or so, were left without further running, and a few were connected for diagnosis with other protests.
The election protest can be submitted to the Supreme Court only in writing. Other forms such as fax, e-mail or ePUAP are unacceptable. It can be submitted directly to the Supreme Court or in a Polish post office.
The protest may apply to both the circumstances regarding the first round of the presidential election, which took place on May 18, and the 2nd round of June 1. If the voter is abroad or on a Polish sea ship, then the protest can entrust a territorially appropriate consul or ship captain. However, he must add a notification to the appointment of his representative residing in a country or a proxy for service of inhabited in the country.
If the protest is to be recognized by the Supreme Court, it cannot contain formal deficiencies – it must meet the requirements set out in the electoral code and the general terms of the pleading. Detailed requirements relating to electoral protests are included on the SN website.
After recognizing all election protests, based on the report on the election presented by the PKW, the Supreme Court decides on the validity of the election of the President of the Republic of Poland – it must do so within 30 days of making the results of the choice to the public. This means that the last day the decision must be made will be on July 2 this year.
Pursuant to the provisions introduced in 2018 during the PiS rule, competent for considering election protests and finding the validity of the election, the Extraordinary Control and Public Affairs Chamber of Supreme Court is created at that time. It is made up of persons appointed after 2017 to the office of a judge at the request of the National Council of the Judiciary shaped in the manner specified in the provisions of the CRS Act of 2017. For this reason, the status of this chamber is questioned by the current government, which recalls here, among others Jurisprudence of the Court of Justice of the EU and the European Court of Human Rights. Before 2018, the electoral issues were considered by the then Insurance and Public Affairs Chamber.
Last week, the first president of the Supreme Court Małgorzata Manowska stated that all public statements that undermine the constitutional competences of the Chamber of Extraordinary Control and Public Affairs of the Supreme Court to decide on the validity of the election of the President of the Republic of Poland result from ignorance of the law or are motivated by the intention of political destabilization.
