The Trump administration has canceled a recommendation issued by the Biden government that forces hospitals to provide emergency abortions, even in the states where this procedure is restricted.

The Trump administration revoked on Tuesday a recommendation issued in July 2022 by the Health Department, during Joe Biden's term. It demanded hospitals around the country to carry out emergency abortions when the patient's life was in danger, even in states that impose severe abortion restrictions, The New York Times reports.

The measure had been adopted shortly after the US Supreme Court annulled the historical decision “Roe v. Wade”, which for 50 years guaranteed the federal law on abortion.

The law of emergency treatments remains valid

Although the recommendation was withdrawn, the 1986 federal law on emergency medical treatments, known as Emtala, remains in force. This provides that patients must receive medical care in emergency, regardless of circumstances.

“Patients, including pregnant women, are entitled to all the rights and protection provided by this federal law”transmitted the Center for Medicare and Medicaid services (CMS), a division of the Health Department, on its official website.

Experts: “Green wave is given to the refusal of treatments”

Health specialists warn that the decision could have serious consequences. “The cancellation of the recommendation gives practically the green wave to the hospitals in the Republican states to refuse the hospitalization of the pregnant women in danger”, Stated Lawrence O. Gostin, medical law expert at Georgetown University.

Abortion, again a hot political topic

Since the decision of the Supreme Court of 2022, each US state has the freedom to decide abortion legislation. Many Republicans have adopted restrictive laws, and President Donald Trump has played an essential role in this change, after appointing three conservative judges at the Supreme Court during his first term.

Since his return to the White House in January, Trump has revoked two other decrees signed by Joe Biden who guaranteed access to the abortion pill.
