Allegations for two former CBA officers in the investigation of Pegasus

In the investigation regarding the use of software Pegasus, the allegations of exceeding the rights were heard on Wednesday by the former director of the CBA delegation in Warsaw, Jarosław W. and former head of the department and operational and investigation of this delegation Katarzyna S. – Przemysław Nowak, spokesman for the National Prosecutor's Office.

According to prosecutor Nowak, the allegations are associated with the fact of conducting operational and reconnaissance activities against former Sopot President Jacek Karnowski “despite the lack of factual and legal grounds.”

“Operational activities consisted of, among others, obtaining and consolidating the content of telephone conversations and data contained in the so -called telecommunications end devices and were conducted from November 2018 to May 2019, including using Pegasus software” – noted the spokesman PK.

As the prosecutor pointed out, “operational and reconnaissance activities, including operational inspections, were initiated and then carried out, despite the lack of factual and legal conditions conditioning the admissibility of their use.” “The allegations also apply to extorting untruth in the decisions of the District Court in Warsaw by insidious misleading judges as to the existence of premises for applying and extending operational controls” – he added.

“Jarosław W. and Katarzyna S. did not admit to committing the alleged crimes. Katarzyna S. refused to explain, while Jarosław W. exercised the right to provide explanations,” said Prosecutor Nowak.

W. and S. were detained on the order of the prosecutor from PK on Tuesday. In the PK, the PEGASUS SPEAKS is dealt with by investigating team No. 3. The proceedings concern exceeding the rights and failure to fulfill their duties by public officials; It is examined, among others The issue of the legality of operational and reconnaissance activities undertaken with the help of Pegasus, and the circumstances regarding its method of use are studied, among others towards the political opponents of the then ruling team, and the method of obtaining classified materials.
