The Ministry of Family, Labor and Social Policy is analyzing the possibility of eliminating the thresholds to disability for people with disabilities. He turned to the Ministry of Finance in this matter. The abolition of the so -called The disability trap is one of the obligations of the Civic Coalition before the parliamentary elections.


From the so -called People with disabilities that resign from work or professional promotion are dealing with a disability pension, so as not to exceed the income thresholds entitling to a social pension or disability pension.
The abolition of the so -called The disability trap was one of the elements of the “100 specifics per 100 days” program announced by the Civic Coalition before the parliamentary elections in 2023.
This topic was the subject of the meeting of the Monday meeting of the Personal Subcommittee on people with disabilities and social inclusion. Deputy Director in the Social Insurance Department at MRPiPS Sebastian Kamiński admitted that recently the ministry has been received by reports from people with disabilities that signal issues of suspension and reduction of retirement and disability benefits.
“In accordance with currently applicable regulations, the right to pension benefits is suspended in the event of revenues in the amount higher than 130 percent of the average monthly remuneration for the calendar quarter announced by the president of the Central Statistical Office,” explained Kamiński.
He emphasized that from June 1 it is PLN 11,651. This means that exceeding this ceiling causes suspension of payment of the benefit.
“The second threshold is 70 percent from June 1 is 6273 PLN 60 gr. It exceeds that the benefit decreases by the amount of exceeding, but not more than the amount specified and this is currently PLN 936 61 groszy and 704 PLN 75 grosze. Of course, we are talking about a fork from 70 percent to 130 % of the average monthly salary,” said Kamiński.
He announced that the Ministry was analyzing the abolition of these thresholds. At the same time, he noticed how important the professional activation of people with disabilities is.
“Until now, a disability pension for work was such a compensation (…) due to the fact that due to health condition, the person could not achieve such income as if he were healthy. Here is simply a change in the approach, it is necessary to approach it systemically” – emphasized Kamiński.
He reported that the ministry asked the Ministry of Finance for financial possibilities in this respect.
“I can say that the ministry sees this problem, wants to approach it in a comprehensive way, make economic, legal and social analyzes. Only after these analyzes and obtaining a positive position of the Ministry of Finance will it be possible to present proposals for legislative changes in this respect,” said Kamiński.
In turn, the deputy director in the office of the Government Plenipotentiary for Disabled People Andrzej Łosiewicz emphasized that one should strive to liquidate the so -called disability trap. He also reminded that the ministry is underway on the Act on personal assistance, whose solutions may contribute to increasing the professional activity of people with disabilities.
“European countries, not all, but those that have the highest indicators of the activity of people with disabilities, do not have this limit, so having in mind the remaining elements of the system, i.e. assistance and assisted employment, we should strive to try to eliminate the disability pension trap,” said Łosiewicz.
From 2022, a person earning a social pension is settled after the calendar year – annually or per month, depending on which way is more favorable to her. Earlier, the pension was suspended on a regular basis – for each month.
The reduction or suspension of a social pension is influenced by, among others Revenue generated from activities subject to compulsory social insurance, e.g. from work under an employment contract, contract-debts or non-agricultural activities.
To receive a social pension, you must be an adult resident of Poland and have an important medical certificate of total incapacity for work either permanent or temporary. A social pension is granted when the inability to work arose as a result of a illness or accident acquired before the person receiving the benefit of 18 years, while studying (up to 25 years), as well as during her doctoral studies or scientific aspirant.
From March 1, 2025, a social pension and due to total incapacity for work is PLN 1878.91. In turn, the pension due to partial incapacity for work is PLN 1409.18. (PAP)
