The government changes the provisions on electro -tripades. Photovoltaic panels in the crosshairs


On Thursday, the government of the government's legislative and program works published assumptions of the draft amendment to the Act on useful electrical and electronic equipment and some other acts. The novella – in addition to the Act of 2015 on used electrical and electronic equipment, will also change the Act of 2013 on packaging and packaging waste management, the Act of 2005 on recycling of withdrawn vehicles from operation and the Act of 2012 on waste.
As explained in the assumptions for the project, in accordance with applicable regulations, the division of obligations between the introductory equipment and owner of used equipment depends on this, whether it was marketed until August 13, 2005 (so -called “former equipment”), or later. At the same time, the regulations oblige to introduce electrical and electronic equipment to achieve minimal annual levels of collection, followed by recovery and preparation for re -use and recycling of such equipment.

The planned novella is to introduce the EU Directive 2024/884 from 2024 to Polish provisions, according to which the “former equipment” will be considered in the Act on useful electrical and electronic equipment, equipment intended for households introduced on the market before 13 August 2005,, Photovoltaic panels for households placed on the market before January 1, 2016. and the equipment underestimated in the Act, the placed on the market before January 1, 2018.

The applicable regulations include the following equipment: large -size and small -scale household appliances, IT and telecommunications equipment, consumer equipment and photovoltaic panels, lighting equipment, electrical and electronic tools, except for large -scale stationary industrial tools, toys, recreation and sports equipment, medical products with the exception of all products. Panels at the user's expense
The list was reported that, in accordance with the proposed regulations, users not intended for households will be covered by the obligation to finance the development of them used by them photovoltaic panelswhich have been marked Between August 13, 2005 and December 31, 2015. and equipment not mentioned in the Act, which was marketed between August 13, 2005 and December 31, 2017. The introductory equipment will be released from this obligation.
In addition, the amendment aims to include in the laws of packaging and packaging waste in laws, as well as the recycling of withdrawal vehicles from the operation of one of the provisions of the EU Directive 2018/851 of 2018, i.e. the introduction of an authorized representative of an authorized representative. This institution is to be modeled on the provisions of the Act on useful electronic electrical equipment. The amendment to set out the rules for its determination and a list of entities that can function in this nature.
The list states that currently entrepreneurs who are based outside Poland are not able to establish an entity responsible for performing duties related to packaging management or recycling of vehicles that they bring to the market. After the amendment to the provisions, in the event of the establishment of an authorized representative, his principal will only act through this entity, and the authorized representative will be responsible for performing his statutory duties. Due to these changes, the amendment also adapts the relevant provisions of the Waste Act.
The planned date of adopting the novella by the government is the second or third quarter of this year.
