The draft amendments planned in the amendment to the Act on compulsory insurance, the Insurance Guarantee Fund and the Polish Motor Insurers' Office and the Act on population register were published on Thursday in the list of legislative and program works of the Council of Ministers.

The planned amendment assumes enabling insurance companies to check whether the PESEL number of the Customer buying civil liability insurance is reserved. If so, the company will be able to refuse to conclude a contract. “In accordance with currently applicable regulations, an insurance company offering compulsory insurance is not able to refuse to conclude such a contract. Therefore, it is proposed to modify the provision in such a way that in the event of a PESEL number reservation, the insurance company will be able to refuse to conclude an insurance contract” – the Ministry of Finance pointed out.

“The aim of the designed changes is to limit situations in which contracts of compulsory civil liability insurance are concluded for damage to damages arising in connection with the movement of these vehicles, using stolen personal data. The increasing number of theft of PESEL numbers from various records meant that criminals began to use them to conclude a compulsory insurance agreement for motor vehicle owners, which is stolen. Personal data ” – we read in the information.

The bill is to be adopted by the government in the second quarter of this year. (PAP)
