The effects of the work of the government deregulation team begin to translate into the activities of individual ministries. Among them was also the Ministry of the Climate and the Environment, which on May 9 published two bills on the website of the Government Legislation Center. One of them changes the Act on nature protection, introducing facilitation in removing trees and shrubs from private plots, The second one is aimed at simplifying for recipients and energy producers.
The draft act amending certain acts in order to deregulation in the field of energy, which is mentioned here, focuses on five issues, and its consultation will last only three days – because the government depends on time.

What problems should the proposed changes meet? First – excessive complication of electricity bills. “Electricity recipients in households encounter considerable difficulties in understanding individual positions on the electricity account” – we read in the justification of the project.
So we are to gain unified formulas for form, which clearly lists the total amount and fees for the rotary and distribution parts. “Energy companies are expected to immediately adapt the appearance of the first pages of the accounts to the introduced regulations” – adds an assessment of the effects of regulation.

Less requirements for smaller ones
For energy and business producers, the ministry has prepared the idea to optimize the use of network infrastructure – it is about the consolidation of the Cable Pooling formula, i.e. the possibility of using one connection to the network by several installations. The option will become available to energy storage, which, according to the authors of the project, will speed up investments in renewable energy without the need to expand the network and allow better development of surplus of renewable energy.
On the other hand requirement to obtain a license for electricity production will only apply for sources with installed power above 5 MWnot 1 MW so far. And here the intention is clear – the abolition of bureaucratic obligation is to stimulate the development of the industry, and will also relieve the administration.
A similar meaning is expressed by the fifth of the proposal regarding the requirement to have a building permit by solar installations. As long as the installation will cover only its own energy demand and will not be in any protected area (in the National Park, nature reserve, Natura 2000 ETC area), up to 500 kW will be able to do without permission. The provisions in force today designate this threshold at an altitude of 150 kW.
According to the assessment of the effects of regulation, by raising the company's threshold they will “be able to meet their demand for electricity faster and in a larger scale,” and thus – reduce the cost of conducting business.
Distributed energy will gain
As part of short consultations, the project will go to 27 entities from the energy industry, including the Energy Market Agency, the Energy Chamber of Energy and Environmental Protection, the Polish Wind Energy Association, the Polish Photovoltaics Association or the Polish Society for the Transmission and District of Electricity. The act is to come into force 14 days after the date of its announcementexcluding the raising of the licensing threshold – this is to apply from the beginning of next year.

As for facilitations in obtaining concessions and building permits, the expert indicates positive effects for prosumers and small companies. – these types of simplifications comply with the recommendations of institutions such as the International Energy Agency or the European Commission and They can significantly contribute to the development of distributed energy and transformation of the power system – indicates.
