Voice voting after 21 by people who came to the election, but could not enter the polling station before the end of the vote, is acceptable and does not violate the silence of the election – the Supreme Court recognized on Wednesday.


The Chamber of Extraordinary Control and Public Affairs of the Supreme Court at classified meetings recognized the complaints of the proxies of the election committees of three presidential candidates for the PKW guidelines for regional committees.
One of them was made by the representative of the election committee Karol Nawrocki. It concerned, among others a point of guidelines referring to the situation when the hour of voting ends on the day of the election, but there is still a queue of those willing to vote, who arrived there before 21.00.
“The provisions of the Electoral Code clearly state that voting takes place from 7am to 9pm. They also clearly state that the chairman of the regional commission is finishing the work and closes the premises of the Commission at 21.00. They also clearly indicate that they can also vote exceptionally after 21.00, voters who reported to the commission's premises” – argued the authors of the complaint.
At this point, the Supreme Court considered the allegation unfounded, emphasizing that the voter could not bear the “negative consequences of not adapting the polling station to the room in it more authorized people”.
