Can you cut a tree on the property? The government changes the rules


Winding trees on a private plot will be easier? Current regulations provide that the administrative body – most often the head of the commune, mayor or city president – has 21 days to conduct a tree inspection, and then 14 days to raise an objection. However, if the inspection is not carried out on time, the procedure can be significantly extended. In practice, this means that plot owners often have to wait much longer.
“The lack of inspection within 21 days means that the deadline for raising an objection does not start running, which leads to unjustified extension of proceedings” – we read in the description of the designed changes.
The proposed amendment introduces a uniform 35-day period calculated from the date of reporting the intention to cut the tree. If at this time the authority does not object, the owner of the plot will be able to start removing the tree on the basis of the so -called silent consent.
According to the Ministry of the Climate and the Environment, which has prepared the project, this change aims to simplify the procedures and secure the interests of the applicants against the length of administrative proceedings.

“The designed term will discipline the authorities to inspect in the original 21-day period, and at the same time reduce the nuisance associated with the expectation of the decision. Shortening the duration of the proceedings will increase safety in cases where the tree is a threat”-we read in the justification of the project.
The new regulations are aimed not only at improving administrative efficiency, but also to increase the comfort of private plots owners. The introduction of a bright time frame will avoid situations in which decisions regarding tree felling are unnecessarily delayed.
