The company that was supposed to build Pozdeev Center will pay 15 million to the budget of Krasnoyarsk

The court ordered LLC Promstroyinvest to pay 15 million rubles for using an advance on an invalid contract for the construction of the Pozdeev Center in Krasnoyarsk. This was told in the prosecutor's office of the region.

The contract for the preparation of the project of the Center, which was planned to be built on the ground -based square, was concluded in February 2023 between the regional capital construction department and LLC Promstroyinvest. The company was supposed to receive 1.7 billion rubles for work. However, the prosecutor's office considered that the government of the region in the documents unreasonably limited competition and the documents were signed illegally.

The regional prosecutor through the court achieved the recognition of the contract invalid. An unlawfully received advance payment of 105.2 million rubles, interest for using other people's money of 16.1 million rubles and interest on the amount of debt until its actual payment was collected with LLC LLC LLC. The company did not agree with the court decision and appealed it

“The third arbitration court of appeal rejected the arguments of the defendant’s complaints on the merits of the claims and changed the decision, reducing the amount of interest for the use of other people's money, based on the amount mastered by the defendant-34.2 million rubles, not the entire advance,” the press service of the supervisory authority said.

According to the cassation representation of the prosecutor's office, the court abolished the decision of the appeal on reducing interest on the use of other people's funds, since the money is reserved by the company from the moment of receipt to the account, which means that the obligation to pay interest occurs for the use of the entire advance amount.

Now LLC Promstroyinvest will pay several million rubles to the budget of Krasnoyarsk. This will be controlled by the prosecutor's office.
