The Krasnoyarsk Prosecutor's Office wants to recognize the agreements on the protection of city cemeteries through the court

The prosecutor's office of the Krasnoyarsk Territory asks to recognize the contracts for the provision of services for the protection of city cemeteries.

The corresponding lawsuit was received by the arbitration court. The defendants indicate the Department of the city house and transport of Krasnoyarsk, as well as the Elbrus security agency. In the document, the prosecutor's office indicated that the mayor's office concluded 10 contracts for the protection of cemeteries – Shinnikov, Korkinskoye, Nikolaev, Troitskoye, Basayskoy, Torgashinskoye, Zlobinskoye and Badalykskoye. All of them are concluded with the only supplier without holding the competition. The price of each contract did not exceed 600 thousand rubles. The total amount of unjust enrichment amounted to 4 million rubles.

“However, as the supervisory authority believes, there was an artificial“ crushing ”of a single purchase on many purchases up to 600,000 rubles. Each in order to bypass competitive procedures, ”the court explained.

All contracts were consisted with the protection of cemeteries in the territory of Krasnoyarsk.

“Under such circumstances, the signing of 10 identical agreements in the amount of up to 600,000 rubles. Each is an artificial fragmentation of the transaction for formal compliance with special restrictions provided for by Federal Law No. 44 -FZ, which leads to restricting the access of other business entities to participate in the tenders for the right to conclude a contract, ”the statement of claim.

The statement of claim was accepted for the proceeding of the court, the preliminary court hearing was scheduled for May 14.
