USR announced on Thursday that it will appeal to the High Court of Cassation and Justice against the decision taken by the Bucharest Court of Appeal, which has established that the party cannot campaign for Nicușor Dan in the presidential race.
The party described the decision of the Bucharest Court of Appeal as a “dangerous” and claims that, thus, the court “censors the decisions of the political forums of a party and decides on a political strategy”.
“Moreover, today's decision forbids a party member to have their own political opinions. Political parties are the free expression of citizens who choose to associate and act politically on behalf of common values. As long as a decision is adopted in the statutory forums of a party and does not violate the Constitution, the freedom of expression should not be transmitted.
The formation will attack the decision at the High Court.
“We will appeal against the decision of the Bucharest Court of Appeal, given the freedom of thought, opinions and the right to free expression. Practically, to citizens who have been associated in a party are forbidden the right to express their political will freely and to decide who supporting,” the statement said.
USR claims that the decision of the Bucharest Court of Appeal represents “a dangerous precedent”.
“If this decision remains final, any party president could act against his own party, blocking democratic decisions made by the management forums. The USR will challenge this decision to the High Court of Cassation and Justice and will go to the end to defend the political and constitutional autonomy of the parties, but especially the Romanian”.
“An entire system has been moving to stop USR”
The leader of the USR deputies, Ionuț Moșteanu, argues that “it is clear – for us, and for more and more Romanians – that a whole system has been moving to stop the USR from making the correct political decisions during this difficult period.”
“By the decision of the Court of Appeal of today, by the illegal promotion that benefits from the PSD and PNL, by the reaction never promptly to make checks. We do not give up.
USR announced last week that he withdraws the support of Elena Lasconi, the leader of the party, and will support Nicușor Dan in the presidential race, but the Central Electoral Bureau has subsequently established that the party cannot campaign for the independent candidate, as he already has an official candidate. The formation appealed the decision, but the Bucharest Court of Appeal rejected the appeal on Thursday.
