The courts of Krasnoyarsk continue to use the methods contradicting constitutions, placing the accused on non -violent articles in cells during the hearings, according to the defender of the former State Duma deputy and the deputy of the Legislative Assembly of the Krasnoyarsk Territory Sergey Natarova Alexander Khopot.
He recalled that since December 2021, Sergei Natarov took part in more than 100 court sessions. The part took place in video communication mode, and during the full -time presence of the accused in the courtroom, he was placed in a metal cage.
“Despite the order of the President of the Russian Federation, Vladimir Putin of December 7, 2022, obliging before May 1, 2023 to stop the use of handcuffs and strict limit measures for women, children and accused of non -violent crimes, the courts of the Krasnoyarsk Territory continue this practice, ”said lawyer Alexander Khopot.
The content of non -amicable people in cells and handcuffs contradicts Article 21 and 49 of the Constitution of the Russian Federation, guaranteeing the respect of human dignity and the presumption of innocence, the lawyer notes. Protective cabins and other designs interfere with confidential communication with a lawyer and create psychological pressure on the defendants.
An international practice is of a similar opinion – The UN Committee on Human Rights also indicated that the accused should not be kept in handcuffs and cells.
Defense filed a request for the placement of the defendant in the courtroom outside “Cells“but received the refusal of the court. Now lawyers intend to appeal this decision in the Krasnoyarsk Regional Court and appeal to the Commissioner for Human Rights.
