Minister of Justice Waldemar Żurek announced on Thursday initiating recourse lawsuits for the so -called Neosędziów, as a result of actions that – as he noted – Poland must pay compensation based on judgments of the European Court of Human Rights.

On Thursday during a press conference, Żurek announced the initiation of recourse lawsuits towards “people who are so -called neo -sets in the Supreme Court.” As he said, their appointment in a defective procedure makes them “They do not form a court”, but receive remuneration for the entrance to the courtroom. – I am quite consistent in these activities and I will initiate such recourse lawsuits – he announced.

If a public official or any other person causes damage to his fault, then the one who paid for this damage has the right to claim in the so -called regression of these funds. So for me it is a completely unacceptable situation when the state budget (…) must pay compensation for the ECtHR judgments, only for participating in the courtroom in the meeting – he said.

As he assessed, these are often great lawyers who “know that compensation will be for their actions”, which results from established case -law. He also appealed to the so -called neoSziów, that they refrain from adjudicating until this situation is regulated by law.

He announced that when the first recourse lawsuit appears, he would meet with journalists and discuss the premises why in his opinion and “according to many lawyers in Poland it can be an effective way to stop the compensation that Poland pays”.

Żurek spoke at a press conference, among others, on statutory priorities. – They are already very advanced at the stage. After the withdrawal of our applications from the Venetian Commission, this point on Polish lawsuit is no longer on the agenda of the Venetian Commission – he said. He noted that when a ready law regarding the status of the so -called Neosędzi, a separate conference and its assumptions will be organized. In parallel – he emphasized, work is underway on the National Council of the Judiciary, but in fact it is a law that is to exercise the judgments of the European Court of Human Rights.

The jurisprudence of the European Tribunal is clear – where in the Supreme Court the neoSzieli come out in the Supreme Court, there is no court, they do not form a court, Poland pays compensation for it. We have already paid over 5.5 million compensation also concluded by the Ministry of Foreign Affairs by settlement – the minister informed. He added that “where the neo -sessels would go to the courtroom, these matters will come.”

– So we must decide what to do about it – he emphasized and informed that the act regarding the return of judges from resting, or voluntary extension of the work of judges is being prepared.

There is a nomination crisis. Due to the fact that, according to not only case -law, but many authorities of the law, we do not have a legal national council of the judiciary, we do not announce new jobs in the courts, and there are a lot of cases and citizens suffer from it. So we have a prepared project that will allow judges from a state of rest, in some part of the full -time jobs, to return to adjudicating, or will allow the working time of judges who would retire. They would only submit an appropriate medical certificate that they are ready to continue to serve – said Żurek.
