The ex-head of the residence permit of the Krasnoyarsk Territory did not achieve a change in the verdict for fraud

In the Krasnoyarsk Territory, a verdict in relation to the ex-head of the regional housing construction fund Sergei Berdousov, who was found guilty of fraud with means of regional subsidy, entered into force.

The prosecutor’s office reminded that the court found the ex-official guilty of abuse of powers (part 2 of article 201 of the Criminal Code of the Russian Federation) and sentenced to 5 years in prison with a colony of general regime with deprivation of the right to occupy leadership positions in the field of housing construction for 2 years. In addition to this, in favor of the Ministry of Construction and Housing and Communal Services of the region, the court recovered damage in the amount of 100 million rubles.

However, the convict decided to appeal the verdict with whom he did not agree. He filed a complaint with the Krasnoyarsk Regional Court and asked to cancel the sentence, insisting on the absence of a crime and the presence between the Ministry of Construction of the Territory and the head of the Civil Law Relations Fund.

But the arguments of the complaint were rejected. On the proposal of the prosecutor, the Judicial Collegium clarified the wording of additional punishment – with the deprivation of the right to engage in activities related to the performance of managerial functions in a commercial organization in the field of housing construction for 2 years. The sentence entered into force.

Recall that in 2019 the fund provided a regional subsidy of 100 million rubles for the construction and purchase of housing for employees of healthcare institutions, culture, sports and social protection. The head of the organization reported to the regional Ministry of Construction on the successful delivery of 27 apartments in a multi -apartment building in the ICRN recently built at the expense of the budget. But citizens did not receive housing. The prosecutor’s check found the cause of the inconsistencies. It turned out that the general director of the Fund took advantage of the subsidy to resolve personal problems. He used 11 apartments as a deposit under a loan agreement to pay off debts. The man sold the remaining 16 premises, and ordered money at his discretion.

He did not return the funds, and submitted an inaccurate report on the successful implementation of the state program to the relevant ministry. Also, the ex-head, during the labor dispute, sued the employer more than 3 million rubles, without intending to pay off the debt to the budget for his illegal actions. The prosecutor’s office noted that at the trial, the ex-official did not admit his guilt completely. He explained that he acted exclusively in the interests of the fund, corrected his plight and wanted to pay off old debts.
