The military participating in mercenary activities risk from 5 to 10 years in prison, according to a draft law

The military personnel taking part in mercenary activities or security and personal protection activities can be sentenced to prison from 5 to 10 years, provides a draft law submitted by USR in Parliament, writes News.ro.
USR deputy Bogdan Rodeanu, the author of the project, explained that the initiative offers the Romanian state an instrument that does not exist at this time. Mercenaria is not defined in the law, and this means that the institutions of force do not have legal framework to manage disciplinary deviations of this type.
The draft law defines the mercenary activities by “the activity of any person who: a) is specially recruited in the country or abroad to fight in an armed conflict; b) in fact, it takes part in hostilities; combatants having an analogous degree and function in the armed forces of this party;
“The participation, in any form, of the military personnel in the activity, of the soldiers and professional grades in activity, of the civil servants with special status from the public order and national security structures and the penitentiary police officers or to the activities of mercenary at 5 to 10 years and the prohibition of rights.
If the deed provided in par. (1) is committed during the state of war, the punishment is life imprisonment or imprisonment from 15 to 25 years and the prohibition of rights. The attempt is punished ”, also stipulates the draft normative act.

The initiator of the project explained that including the security and protection service provided by the military will be passed as a mercenary work.
“When this draft law will be promulgated and become a law, the respective person who has been medically suspended and who goes through such mercenary activities, falls under criminal incidence, that is, imprisonment. Beyond the fact that by the regulation and by the status of the military or the policeman he has forbidden in a certain form, and in this area, And the provision of security and personal protection services, other than those authorized by the Romanian state, ”Rodeanu said.
The legislative initiative comes after more data appeared in the public space about the mercenary activities carried out by Romanian military, under the coordination of Horațiu Potra. Recently, the publication Public Record has discovered that in such missions, Potra's people collaborated with organizations accused of war crimes.
