During the fiscal control carried out in the summer of 2009 at the company Touring Europabus Romania, owned by Dragoș Anastasiu, the Inspector ANAF Angela Burlacu found that there were not all the documents to attest to if the company paid all employees the salary taxes. It is about social insurance, the data from the file resolved by the Bucharest Court of Appeal in 2023 shows.

On May 21, 2009, the head of the General Directorate for the Administration of Large Taxpayers (DGAMC) from ANAF ordered a partial fiscal inspection at Touring Europabus Romania to target the value added tax, the profit tax, the tax on dividends, the tax on non -residents, as well employer and insured.

In the control team were appointed three ANAF inspectors: Angela Burlacu, Aurelia Voicilă and Nicoleta Cojocaru, but the actual control was carried out only by Burlacu.

Voicilă told the hearings from the Bucharest Court of Appeal that he “participated only in the incipient procedure of the control, at that time his activity being reduced to that of a beginner. He did not have an active participation in the control, participated at the time of opening the control when the unique control register was completed”.

The second team inspectors, Nicoleta Cojocaru, also said that “he did not actually participate in carrying out the control, his name appearing automatically in the fiscal inspection report as it was designated on the basis of the service order”.

Tactics of the ANAF inspector

Being alone in control, the inspector Angela Burlacu led the course of the inspection in her own interest when she found the first irregularities. The data in the file show that the practice of the operation of ANAF was not a single one, but also in the case of other controlled companies, when he discovered irregularities, they forced them to conclude consulting contracts with his family company to escape problems.

Several directors from Touring Europabus Romania, owned by Dragoș Anastasiu, told the hearings at the Bucharest Court of Appeal that they were “disturbed” by the 2009 control. And this is because the Burlacu inspector continually threatened to “is a criminal case” and that “the employer can reach prison”.

The irregularities omitted from the report

According to the data from the file solved by the Bucharest Court of Appeal, during the 2009 inspection at Touring Europabus Romania, it was found that “the company is unable to provide all the documents on the basis of which the checks on how to establish, register and declare the obligations due to the employer and insured and insured”.

“The defendant Burlacu Angela Georgeta should have proceeded to find the contravention and apply the corresponding sanction, in accordance with the attribution provided in the job description. By default, because the lack of documents prevents the completion of the fiscal inspection, the inspection was to be suspended until the conditions that generated the suspension. The obligations due to the employer and insured wage income were constituted, registered and declared completely and correctly, it had the possibility to notify the criminal prosecution bodies so that they could determine if the lack of documents hides the commission of criminal nature ”, explained the DNA in the court notification.

The ANAF inspector did not actually record what he found. And he did not apply the contravention sanction provided by law following the deficiencies found in Touring Europabus Romania, the data in the file shows.

“He did not find in the fiscal inspection report these deficiencies and did not make proposals for notifying the criminal prosecution bodies. On the contrary, it indicated the responsibility factors of the controlled company that in exchange for the fiscal inspection it will be concluded for the company and will be allowed to restore the missing documents,” the court.

How to proceed legally

Cătălin Adrian Cojocaru, Deputy General Manager at DGAMC in 2009, when the facts took place, in the meantime aimed at a corruption file, was called by the judges of the Bucharest Court of Appeal to provide clarifications regarding the control of the inspector Burlacu.

He stated at the hearing that “any fiscal deficiency found during the fiscal inspection, including the lack of salary records, had to be presented to the head of service and inserted in the tax inspection report”. And if the wage records were not presented even after the expiration of the term granted in this regard, the criminal prosecution body could be notified, Cojocaru explained to the Court judges.

In the fiscal inspection reports drawn up by the Burlacu Inspectorate after the completion of the control carried out at Touring Europabus Romania in the summer of 2009 “there is no mention regarding the finding of deficiencies regarding the documents attesting the obligations due to the salary revenues”, shows the judges of the Bucharest Court of Appeal in the reasoning of the Burlacu Inspector.

The masked bribe, the “reliable solution”

To close the eyes in front of the irregularities, the official ANAF Angela Burlacu asked the decision makers Touring Europabus Romania to conclude a consulting contract with a company indicated by it. That of his family. The cost was 2,000 euros per month.

Cristian Băciucu, the one who denounced Burlacu at DNA in February 2018, told the judges of the court that he “saw the proposal of the conclusion of the marketing contract as a reliable solution as they escaped, as a protective fee; he knew that the defendant works on ANAF”.

For his part, Dragoș Anastasiu told the DNA hearings of 2018 that he gave the agreement for signing the contract requested by the Burlacu Inspector “as, at that time, the perspective of triggering a criminal investigation and the extension of the controls led to the idea of the insolvency and the dismissal of the personnel, which meant the company, which was to affect the company, which meant more than 20, which meant the company, which meant the company, paid ”.

Anastasiu's explanations

The ANAF official assured both Anastasiu and Băciucu that he has a transition to his head directly from the DGAMC. In order to convince this, he sent Anastasiu to talk directly with the director Cătălin Adrian Cojocaru.

Another four problems without any problems

Since the 2009 Fiscal Inspection, ANAF has carried out three other inspections at the company Touring Europabus Romania: in November 2010 and in April 2015. All the controls were completed without finding deficiencies, the data from the DNA file shows.

Over 150,000 euros is bribe, masked in luxury consulting and holiday contracts, which the inspector Angela Burlacu from the company of Deputy Prime Minister Anastasiu received for more than 8 years (from the end of 2009, until the summer of 2017).

Burlacu was definitively sentenced in 2023 to 5 years and 2 months imprisonment. Next week, the Ploiești Court will judge his request regarding the conditional release.

Who are the ANAF inspector whistleblowers

The corruption facts of the inspector Burlacu were denounced by the business partner of Dragoș Anastasiu, respectively another businessman from Ilfov, who has no connection with the business of the current Deputy Prime Minister, according to the decision 534/2021 of the Bucharest Court.

The second denuncier, with IT business, was also pressed to conclude fictitious consulting contracts with the company of the inspector Burlacu, “in order to have no problems”

Although in the sentences of the Bucharest Court, only these two denouncers are referred to, the DNA communicated that Dragoș Anastasiu would have had the quality of denouncer and that in his case the classification solution was adopted.
