CCR, controversial decision. Wealth statements no longer have to include the goods and revenue of the spouses and children

The Constitutional Court decided on Thursday that statements of wealth and interests should not include the goods and income of the spouses and children, sources close to the Court told G4Media.ro.

The RCC declared the article article unconstitutional, par. 2 of the Law on declarations of wealth and interests: “(2) The declarations of wealth are drawn up on their own responsibility and include the rights and obligations of the declarant, the spouse, as well as of the children in maintenance, according to the annex no. 1. ”

The Constitutional Court declared unconstitutional and the article that provides for the publication of wealth statements. The CCR decision cannot be appealed, it is final and mandatory.

According to G4Media.ro sources, the CCR declared unconstitutional and the article art. 12, para. 6: “The Agency ensures the display of wealth statements and interest declarations, provided in annexes no. 1 and 2, on the website of the Agency, within a maximum of 30 days from the reception, by anonymizing the address of the declared buildings, except for the locality, of the address of the institution that manages the financial assets, of the personal number, as well as the statements, as well as the statements. I maintain on the website of the Agency throughout the exercise of the position or mandate and 3 years after its termination and is archived according to the law ”.

On Thursday, six non -governmental organizations appealed to the CCR to apply the principles of the rule of law and they pointed out that “All international standards in the matter of public integrity recommend a transparent system of declarations of wealth and interests ”.
