Reaction from the USR: the President had to consult the parties before appointing a new prime minister, according to the Constitution

USR deputy Alexandru Dimitriu, former secretary of state in the Ministry of Justice, says that President Nicușor Dan should have consulted the parliamentary political parties before proposing a new candidate for the position of prime minister.
“The constitution is very clear: the appointment of a candidate for the position of prime minister must be preceded by the consultation of the parliamentary parties. The consultations held previously had a precise object and produced a concrete result: the appointment of Eugen Tomac for the position of prime minister. The moment he submitted his mandate, the constitutional procedure generated by those consultations ended,” the USR deputy wrote on Facebook.
“Party consultation is not a formality that can be ticked off only once”
He says that the withdrawal of the prime minister-designate is not “an administrative detail”, but the consequence of the fact that he failed to obtain the political support necessary to form a majority.
In these circumstances, a new designation cannot be considered a “mere” continuation of the previous procedure.
“The political situation has changed, and the Constitution requires the resumption of consultations with the parliamentary parties before the nomination of a new candidate. Party consultation is not a formality that can be ticked off once and used for any subsequent nomination.
It must exist for each designated candidate so that the president can assess the actual political support that exists at that time. Respect for the Constitution does not depend on the political urgency of the moment. Precisely in difficult moments, the constitutional rules must be strictly respected”, pointed out Alexandru Dimitriu.
