The two prosecutors from Constanța were detained in the corruption case. Lawyer: “It's not about the spade”

Prosecutors Gigi Ștefan and Teodor Niță from the Prosecutor's Office of the Constanța Court of Appeal were detained during the night by the General Prosecutor's Office, for 24 hours, in a case of abuse of office and other corruption crimes, judicial sources told Agerpres.
The two were questioned for several hours at the headquarters of the General Prosecutor's Office, Teodor Niță being brought by van from Constanța.
“Mr. Niță is a defendant in the file, the preventive measure of detention was given, tomorrow we will challenge this measure at the High Court”, confirmed after the hearings Teodor Niță's lawyer, who refused to make any further clarifications.
Later, the lawyer Liviu Zaharia, his second defender, explained in more detail the accusations in the file, reports Seepress.
“The same charge of inciting abuse of office remained. It's not about kickbacks, it's not about money, it's not about giving, taking bribes, as you probably expect and as you've heard,” said Zaharia.
“It is assumed that Mr. Prosecutor Niță Teodor would have instigated a worker from the ISU Constanța not to fulfill his duties or to fulfill his duties improperly. From what I found out, obviously statements were not given at this moment, because we did not have access to the file, we requested this as a suspect. (…) In an hour we acquired the status of defendants, without allowing us to study the file, to clarify ourselves in concretely on the accusation brought”, added his defense attorney to the Niță prosecutor.
According to the lawyer, the alleged act was committed on January 15, 2026, and his client did not make any statements to the prosecutors.
“In my personal opinion, it is an exaggerated measure. In other situations, other qualities, other people would certainly not have ordered such a measure,” said lawyer Zaharia, referring to the measure of detention and the proposal for preventive arrest.
Prosecutor Niță's defense attorney stated that he was “surprised” to see pictures of money in the press.
“It's not okay to release to the public, especially to the press, data from the investigation that is at least secret. Especially when he is under criminal investigation. I noticed in the press, I don't want to say where, pictures from a blackout. And I was called by a colleague of yours who posted a picture from the blackout. Be very careful, a picture from the blackout that I didn't see, although I asked. Here we are discussing the respect of rights. Even if he is a prosecutor, even if he is not a prosecutor, we all have the same rights before the law”, said Zaharia, upon leaving the General Prosecutor's Office.
The searches of the two prosecutors
The General Prosecutor's Office carried out, on Wednesday and Thursday, 13 searches in a case of influence peddling and corruption crimes, including at the headquarters of the Prosecutor's Office next to the Constanța Court of Appeal, targeting also two prosecutors from this prosecution unit – Gigi Ștefan and Teodor Niță.
The descents took place in a criminal file in which investigations are being carried out under the aspect of committing the crime of influence peddling, as well as other corruption crimes, committed between December 2025 and May 2026.
Later, on Thursday, the investigators would have found the sum of 100,000 euros in the office of the prosecutor Gigi Ștefan and another sum of 30,000 euros in his car.
Gigi Ștefan was the general prosecutor of the Prosecutor's Office attached to the Constanța Court of Appeal, and Teodor Niță was his subordinate.
