The Arbitration Court of the Krasnoyarsk Territory satisfied the claim of the prosecutor's office for the seizure of 17 hectares of land on the right bank of the Yenisei in the Pashenny area in favor of the state. This was reported in the press service of the department.
As the audit established, in 2017, the department of municipal property of the Krasnoyarsk administration transferred federal land to lease and then to the ownership of Krasnoyarsk Shipyard OJSC, although it did not have the right to do so. The plot was sold for 2.6 million rubles with a cadastral value of more than 100 million. The formal reason was the shipyard facilities, some of which had already been demolished by that time.
Later, the land was bought by Flagman LLC for 83 million rubles, after which the site was transferred to the Arban company under a lease agreement. There they planned to build a new residential complex “Portovy” with public spaces, a modern school and a kindergarten. In addition, a training cluster similar to the Sochi Sirius could appear there.
The prosecutor's office demanded that the land be returned to the state, pointing out that the transactions were void since the territory belonged to the Russian Federation. The court agreed with these arguments. At the same time plots under already built houses are not withdrawn – the first quarter, South-East, has already been commissioned.
The Arban company stated that it did not agree with the decision and was preparing an appeal.
“We continue to defend our position as a bona fide purchaser of the land. The right of the previous owner of the land was acquired by a court decision, which guarantees the validity of the rights. The transaction for the acquisition of rights was notarized, using loan funds, that is, it passed numerous checks of banking structures. The question remains open of how the city administration received rental payments into the budget since 2011, and subsequently the redemption payment. We are carefully studying the decision and hope for a constructive resolution of the dispute, taking into account the complexity of the situation,” the company explained.
