A new assault on the courts for “Tour 2 back”. 100 processes opened by a Romanian in a single day against the Constitutional Court. Others demand the annulment of government decisions regarding the organization of elections

One hundred courts in the country – both judges and courts, respectively courts of appeal – registered on April 28 requests regarding the cancellation of the Constitutional Court of Romania (CCR) on the annulment of the elections of 2024, shows the centralized data by HotNews.ro on the portal of the court. At the same time, on Tik Tok and Facebook, Călin Georgescu's supporters are preparing the “last attempt 2 back”: actions in courts asking the decree regarding the appointment of Marcel Ciolacu, respectively of the Government decisions regarding the organization of the presidential elections in May.

The motivation of the High Court of Cassation and Justice (ICCJ) who returned the decision of a judge of the Ploiești Court of Appeal regarding the cancellation of the CCR decision regarding the annulment of the presidential elections did not convince the supporters of Călin Georgescu, who on the social networks prepare a new strategy “Tour 2”.

On April 28, on the day when ICCJ made public the motivation of the decision given on Friday, a Romanian filed 100 other similar applications in courts from all over the country.

In the actions transmitted on the email of the courts of appeal, courts and courts, Virgil Gorcea requests “the annulment of the decision of the Constitutional Court of December 16, 2024, regarding the annulment of the presidential elections”.

The Iași Court of Appeal resolved the man's request on Tuesday, rejecting the request for non -competition. Other files have a deadline on Wednesday, April 30, respectively next week, and in others the courts have not yet set a deadline.

In parallel, on the evening of April 27, Tiktok and Facebook was massively distributed by the lawyer Daniel Chitic in which the Romanians are encouraged to continue the courts. The promotion approach was also joined by the former judge in Botosani, Lăcrămioara Axinte. The initiated approach concerns this time Prime Minister Marcel Ciolacu, the one who signed the Government decisions regarding the organization of the presidential elections in May.

He attached a model of court request, in which his followers are learned to ask:

• 1. Cancellation of Decree no. 1670 from the date 23.12.2024, published in the Official Gazette, Part I, no. 1307 of 23.12.2024 by which it was designated, pursuant to art. 85 paragraph 1, art. 100 paragraph 1 and art. 103 paragraph 1 of the Constitution of Romania, Mr. Ion Marcel Ciolacu as prime minister of Romania;

• 2. The annulment of the Government Decision no. 4 of January 16, 2025 regarding the establishment of the date of elections for the President of Romania from 2025 published in the Official Gazette no. 37 of January 16, 2025;

• 3. Cancellation of the Government Decision 17 of January 28, 2025 regarding the approval of the calendar program for carrying out the necessary actions for the election of the President of Romania from 2025 published in the Official Gazette no. 72 of 29.01.2025;

• 4. The annulment of the Government Decision no. 68 of February 20, 2025 regarding the establishment of measures for the good organization and conduct of the elections for the President of Romania from 2025 published in the Official Gazette no. 157 of February 21, 2025;

• 5. The annulment of the Government Decision no. 79 of February 20, 2025 regarding the establishment of the budget and the expenses necessary for the training, organization and carrying out in good conditions of the elections for the President of Romania of 2025 published in the Official Gazette no. 159 of February 21, 2025;

• 6.. The resumption and organization of the 2 -election tour for the President of Romania triggered in 2024, as they began to take place on December 6, 2924 outside the territory of Romania.

The role of lawyer Daniel Chitic

The next day, on April 29, at the courts of appeal in Bucharest, Iași, Bacău and Constanța were registered the first four requests to sue the Government of Romania, the Prime Minister Marcel Ciolacu and the Presidential Administration according to the model proposed by the Chitic lawyer. In fact, one of the actions registered at the Bucharest Court of Appeal belongs to them and will be judged on Wednesday, April 30.

Lawyer Daniel Chitic is also the one who represents Gheorghița Popescu, the one who obtained the favorable decision at the Ploiești Court of Appeal.

According to the decision of the ICCJ by which the decision from Ploiești was canceled, Gheorghița Popescu, represented by the Chitic lawyer, filed two appeal to the supreme court: a request for an appeal filed in the five -day legal land, provided by the substantive court, and an annulment appeal. This challenges the ICCJ decision, criticizing the resolution of the Constitutional Court's appeal and the General Prosecutor's Office before the expiration of the legal term for exercising the appeal.

Who is Daniel Chitic

Lawyer Dan Chitic was one of the first promoters of Roexit, the exit of Romania from the EU, in 2019, when he launched the idea with Daniel Dragomir, the former SRI colonel convicted for corruption, wrote G4media.
