KSeF has started. The e-invoicing revolution has become a fact

There was no false start. The National e-Invoice System came into force today. Entrepreneurs can now issue and receive invoices on the new electronic platform. “The system started as planned, efficiently and without disruptions,” said Minister of Finance Andrzej Domański.

The long-announced e-invoice revolution has come into force. National e-Invoice System (KSeF) officially launched. Entrepreneurs can now issue, send, receive and store invoices there. Contrary to the fears of many experts and entrepreneurs, the system works efficiently.

“KSeF has started. Planned and efficiently. Without any disruptions. The first thousand invoices have been received by KSeF. We are taking another step in building a modern Polish economy. I would like to thank all accountants, entrepreneurs, integrators and, of course, employees involved in this project,” wrote Minister of Finance Andrzej Domański on Sunday on the X website.

KSeF: who covers the responsibilities

The obligation to issue invoices in the new system in the first stage applies only to the largest companies, i.e. those whose turnover in 2024 exceeded PLN 200 million. There are such companies – according to the estimates of the Ministry of Finance approx. 4.2 thousand

In the second stage that will begin April 1 this yearthis obligation will apply to other companies – except the smallest ones, which are to be covered by it from January 1, 2027 These are enterprises whose monthly turnover, documented through KSeF, does not exceed PLN 10,000. PLN per month.

So much for issuing invoices. However, when it comes to collecting them, this obligation covers all companies from… February 1.

Users: more facilities would be useful

We talked to entrepreneurs who issued invoices in the new system. They said the process was not difficult, but it could be in several places more intuitive. They suggested it would be useful more facilities and tips. However, they admitted that despite these inconveniences, in all cases they managed to successfully go through the entire process in the new system.

By noon on February 1, KSeF had received over 50 thousand invoices.

– Since the launch of KSeF, over 50,000 invoices have been received and approximately 320,000 users have logged into the system. The first data show that the process of using KSeF is running smoothly and the system operates stably and in accordance with the adopted assumptions, said Marcin Łoboda, Deputy Minister of Finance and head of the National Tax Administration.

Not immediately, but within a day

Importantly, invoices in KSeF do not have to be sent immediately after issuance, but immediately – online on the same day, which allows the transaction date to be retained in the system.

In case of no internet connection or failure (offline mode), just upload them until the next day working day, with a QR code in a visual form for the customer, and in the event of a longer technical break – within seven days after restoring access. This excludes the collection of documents at the end of the week or month, but still respects the general deadlines in the VAT Act.

The Ministry of Finance reminds that until this year there will be no penalties for companies for incorrectly applying KSeF.

What invoices are covered by the system?

KSeF in 2026 will not cover either the so-called simplified invoice in the form of a receipt, i.e. a sale that has been documented in the form of a receipt in which the seller has included the buyer's Tax Identification Number and the value of which does not exceed PLN 450 or euro. However, such sales will be subject to KSeF from the beginning of 2027. Also in the case of paper invoices issued using electronic cash registers, a transitional period has been maintained, which ends in 2026.

The KSeF system is not mandatory for consumer invoices, i.e. issued by companies to individual customers. Invoices for electricity, gas, etc. can be issued under the old rules, although the regulations allow companies to voluntarily use the KSeF when documenting sales to a consumer.

– The declarations of the Ministry of Finance regarding the storage, processing and encryption of data related to KSeF prove that the system meets the basic and recognized principles of cybersecurity – said cybersecurity expert Joanna Wziątek-Ładosz for PAP.

The system was postponed several times

The date of entry into force of the KSeF was postponed several times. Work on the legislation regarding the system started in 2020. In December of that year, the list of legislative and programmatic works of the Council of Ministers published information on the planned amendment to the Goods and Services Tax Act, the aim of which was to introduce a system for issuing, sending and storing invoices.

According to the plans of the Ministry of Finance at that time, the system was to be launched at the end of 2021 – first as a voluntary system, and from 2023 it was to be mandatory. In 2022, the date of entry into force of the KSeF was postponed to January 1, 2024, and in the next amendment to the Act, this date was further postponed to July 1, 2024 in the case of large companies and to January 1, 2025 for other VAT taxpayers. Eventually, the system came into force February 1, 2026.
