In Bolshaya Murta, the boiler room operator of a rural cultural center was reinstated at work after the intervention of the prosecutor's office. The prosecutor's office of the Krasnoyarsk region reported this.
In winter, when the temperature in the village dropped to −42 degrees, an accident occurred in the heating system of the cultural center. After this, the management of the institution accused the employee of allegedly not monitoring the boiler at night. As a result, the man was sent to idle time and then fired.
However, an investigation by the prosecutor's office showed that neither the employment contract nor internal documents obligated the boiler room operator to be on duty at night. In addition, the institution’s documents did not specify the start and end times of its work. It turned out that the employee was punished for duties that were not officially assigned to him.
The prosecutor's office also identified other violations of labor laws. They concerned the provision of leaves, instructions on labor protection, familiarization of workers with the results of a special assessment of working conditions and the maintenance of mandatory documentation. After the intervention of the prosecutor's office, the illegal orders of downtime and dismissal were canceled. The employee was reinstated, and the entry in the work book was declared invalid.
The man’s salary was also recalculated for the period of forced absence and he was paid for downtime. The head of the institution was fined for violating labor laws, illegal dismissal and violating labor protection requirements.
