The High Court rejected the appeals filed by prosecutors Gigi Valentin Ștefan and Teodor Niță. The decision on preventive detention is final

The High Court of Cassation and Justice definitively rejected the appeals filed by the defendants Gigi Valentin Ștefan and Teodor Niță against the conclusion of May 15, 2026 by which the measure of preventive arrest had been ordered.

According to the court minutes, the appeal filed by Gigi Valentin Stefan was rejected unanimously as unfounded.

In his case Teodor Nicethe decision was made by the majority, the court also rejecting the appeal as unfounded.

The two defendants were forced to pay 300 lei each, representing legal expenses to the state.

The decision is final and was pronounced on Friday, May 29, 2026, in the Council Chamber of the High Court of Cassation and Justice.

A separate opinion is also mentioned in the court document. One of the judges supported the admission of the appeal filed by Teodor Niță, the partial annulment of the contested decision and the rejection of the proposal for preventive arrest made by the Prosecutor's Office attached to the High Court of Cassation and Justice.

According to the separate opinion, Teodor Niță should have been released immediately under the power of the preventive arrest warrant issued on May 15, 2026, and the legal expenses should remain the responsibility of the state.

“I never even did that”

According to the investigation, prosecutor Teodor Niță would have intervened next to an ISU Constanța officer to help a close friend, a businessman. The accusation made in his case is of inciting abuse of office, the investigators claiming that Niță would have tried to influence the way in which an administrative situation was resolved for his benefit.

“I didn't even do that,” said Niță, on Tuesday, when he was brought to the General Prosecutor's Office.

In the case of prosecutor Gigi Valentin Ștefan, however, the investigation is much broader. According to the General Prosecutor's Office, he would have received approximately 170,000 euros, as well as various goods and services, in just five months. Instead, they would have promised to intervene with magistrates, civil servants, police officers and administrative authorities, in order to obtain favorable solutions in criminal cases or in administrative cases. The accusations against Gigi Valentin Ștefan are influence peddling and influence peddling in a continuous form.

The two were suspended by the Superior Council of Magistracy (CSM) from their positions as prosecutors.
