The mayor of Cernavodă, recently sentenced to 4 years in prison, was released from prison. The supreme court accepted his appeal in cassation

The former mayor of the city of Cernavoda, Liviu Cristian Negoiţă, who was definitively sentenced in January to four years in prison for continuous abuse of office, because he made illegal payments of over 9.3 million lei to a sports club, was released from prison after the High Court of Cassation and Justice admitted his appeal in cassation.

  • The ÎCCJ magistrates considered that the act for which he was convicted is not provided for by the criminal law.
  • The representatives of the Prefecture of Constanta announced that Liviu Negoiţă can return to the position of mayor.

“Admits the cassation appeal filed by the defendant Negoiţă Liviu Cristian against decision no. 16/2026 of January 13, 2026, issued by the Constanţa Court of Appeal – Criminal Section and for criminal cases involving minors and family, in file no. 7594/118/2022. Overturns the contested criminal decision and sentence no. 77/02.07.2025 of the Court of Constanţa, in the criminal case no. 7594/2022, according to article 16, letter b) of the Criminal Procedure Code, acquitting the defendant of the offense under article 132 No. 78/2000 according to article 297 of the Criminal Code with the application of article 35 of the Criminal Code, as the act is not provided for by the High Court of Justice, cited by News.ro.
The court also decided to cancel the execution forms issued against Liviu Negoiţă.
“Cancel the forms of execution issued against the defendant Negoiţă Liviu Cristian, based on the sentence no. 77/07.02.2025 pronounced by the Constanţa Court in the criminal file no. 7594/118/2022, which remained definitive by the decision no. 16/2026 of January 13, 2026, pronounced by the Constanța Court of Appeal – Criminal Section and for criminal cases involving minors, and order the immediate detention of the defendant, if he is not detained or arrested in another case. Remove the provision for the confiscation of 9,307,790 lei for the benefit of the defendant Negoiţă Cristian, ordered under Article 112 letter e) of the Criminal Code.
Also, the magistrates of the High Court decided to lift the measure of the insurance seizure instituted on Liviu Negoiţă's assets.
The decision of the supreme court is final.

He can also resume his position as mayor

The representatives of Constanţa Prefecture announced that Liviu Negoiţă is returning to Cernavodă City Hall following the decision of the High Court of Cassation and Justice, without the need for any prefect's order to be issued.
Negoiţă was sentenced by the Constanța Court of Appeal, in January, to four years in prison for continuous abuse of office. He was tried for making illegal payments of over 9.3 million lei to a sports club.

The Constanţa Court of Appeal had rejected the appeal declared by the mayor of Cernavodă against the decision of the Constanța Court, by which he had also been sentenced to four years in prison, and the decision of the second court was final.
Liviu Negoiţă (PNL) was sent to court by DNA prosecutors because, between April 2017 and August 2019, as the mayor of Cernavodă, he allegedly approved, without complying with the legal provisions, 33 ordinances from the City Hall, by which the illegal payment of the total sum of 9,307,790 lei was ordered, for the benefit of a sports club.
