Eco Sud, investigated by the Competition Council: “It allegedly imposed abusive clauses on the operators”

The Competition Council has announced the launch of an investigation into a possible abuse of a dominant position by the company ECO SUD SA, the administrator of the Ecological Waste Deposit in Vidra commune, Ilfov county. The investigation concerns the way in which the operator would have managed the contractual relations with the companies that mechano-biologically treat municipal waste collected in a mixture.

“The competition authority has indications that ECO SUD SA would have imposed certain abusive clauses on the operators who provide mechano-biological treatment services for mixed municipal waste, starting in 2024”, says the Competition Council, on Monday, in a statement.

The competition authority's investigation was triggered following a complaint filed with the institution.

During the procedure, the inspectors of the Competition Council carried out unannounced inspections both at the headquarters in Bucharest and at the work point in Ilfov of ECO SUD SA.

“The unannounced inspections are authorized by the Bucharest Court of Appeal and are justified by the need to obtain all the information and documents necessary to clarify the possible anti-competitive practices analyzed. Their performance does not represent a preliminary ruling regarding the companies' guilt”, the institution also specifies.

What does the law say?

Competition law prohibits companies in a dominant market position from using that position to impose abusive conditions or limit competition, actions that may affect economic activity and harm consumers.

Central Depot from Mavrodin for the sorting, composting, treatment and storage of municipal solid waste, which serves Teleorman county.

Frateșt Integrated Waste Management Centeri, with storage and sorting activities, serving Giurgiu county.

Bacău Integrated Solid Waste Management System, with storage, transfer and sorting activities, which serves Bacău county.

Girov Non-Hazardous Waste Deposit, with treatment activities, disposal of non-hazardous waste and transfer, serving Neamț County.
