Labor Code 2027. Fines for illegal wages are to increase

Employees who cannot get their remuneration on time may feel a little more confident. The government wants to change the labor code so that dishonest entrepreneurs are actually punished for their inappropriate actions. The Sejm will consider the bill in May, and the changes are expected to be significant and also cover other unacceptable practices.
Fines for basic violations, such as failure to pay wages or breach of employer's obligations, are to increase dramatically. The new regulations may improve the situation of many employees who have previously had difficulty asserting their rights.

As “Gazeta Prawna” explains, the changes are aimed at more effective enforcement of employee rights and limiting unfair practices in the labor market. Higher penalties are intended to deter employers from breaking the regulations, especially regarding under-the-table payments or delays in salaries.

According to the assumptions of changes to the Labor Code, analyzed by “Gazeta Prawna”, fines for basic violations, such as non-payment of wages or breach of employer's obligations, are to increase twice – to PLN 60,000. zloty.
New penalties for employers. The government defends employees
In turn, for paying salaries “under the table” or avoiding alimony deductions, the penalty will reach up to PLN 90,000. zloty. Another new offense is the failure to pay for at least three months, which will result in a fine of up to PLN 60,000. PLN fine or restriction of liberty.
The proposed changes also assume that the employee will receive automatic interest for delays in remuneration, without the need to submit an application. The employer will have to calculate it himself and pay it together with the outstanding salary. Interest will be charged from the day after the payment date, at the statutory rate.

The bill also provides for increased fines for violations of occupational health and safety rules. Currently, fines range from PLN 1,000 to PLN 30,000. PLN, while under the new rules it would range from PLN 2,000 to PLN 60,000. zloty. The new regulations, which will be considered by the Sejm in May, would enter into force on January 1, 2027.
