The prosecutor's office of the Krasnoyarsk Territory filed a lawsuit with the Arbitration Court demanding that the building of the May 1 Palace of Culture in the Leninsky district of Krasnoyarsk be seized from private owners. The department wants to recover from them and other defendants more than 200 million rubles received for renting out the property.

The building at 16 Yunosti Street used to belong to the Biryusa refrigerator factory. After the privatization of the enterprise, the object was transferred to Holt LLC, which, in turn, sold it to IP Gorodova M.P. and Matveeva I.A. As the prosecutor's office points out, during privatization there was a rule: cultural, sports and educational objects can be included in the property being sold, but with the obligatory preservation of their profile. If an enterprise violates this condition, the facility must be transferred to the municipality.

According to the prosecutor's office, since 2010, the owners have leased the building to the municipal autonomous institution “Palace of Culture named after. May 1st.” For this they were paid a total of more than 200 million rubles from the budget.

“In fact, the facility is maintained at the expense of the city budget, its operation was carried out by a municipal cultural institution, the owners of the Palace of Culture avoided fulfilling the obligation to use the facility in accordance with its profile,” the supervisory agency emphasizes.

The prosecutor's office believes that violation of the requirement to preserve the profile of the object is grounds for confiscating it in favor of the city. And the budget money paid for rent must be recovered as unjust enrichment.

The court has already accepted the claim and imposed interim measures: it prohibited the disposal of the building, and also seized the money and other property of the defendants. A preliminary hearing is scheduled for June 9.
