The government announced on Friday that the draft Emergency Ordinance regarding the increase in guarantees for technical connection approvals (ATR) to the electricity network cannot be published in the Official Gazette. Therefore, the ordinance cannot come into force. The reason: an opinion was issued too late, after the approval of the Ordinance, on the morning of the day when the Bolojan Government was dismissed by PSD-AUR motion of censure.
- The Bolojan government is now interim and cannot issue emergency ordinances, being able to deal only with administrative functioning.
The Government stated on Friday that the project “must be put back on the agenda of the Government meeting, when the Executive will again have the competence to adopt this type of normative acts”.
The reason why it no longer enters into force: the Legislative Council issued the opinion too late
The project “will not be published in the Official Gazette and will not enter into force for the time being, as a result of the negative opinion issued by the Legislative Council after the Government was dismissed by a motion of censure by the Parliament”, the Government stated.
It states that the project “included necessary changes to create better premises for fair access to the energy system for investors and to remove speculative practices in obtaining technical approvals for connection (ATR)”.
“The Emergency Ordinance entered the agenda with all the notices. Only, during the meeting, the part with technical connection notices (ATRs) was also added to the tape. When this thing happens, on the tape, you are obliged, and I invoked the article of the law in the HG, when there are substantial changes to the form of the Ordinance, as it was adopted in the government meeting compared to how it was approved by the Legislative Council, you are obliged to send it for a re-approval for the part that was not seen by the Legislative Council. That is, the part with the ATRs is returned, negative or positive does not matter.
The important thing is that after he comes, given that it is a re-approval, you, as the government, must put the Ordinance back on the agenda.

Given that this negative opinion came after the government had been dismissed through the censure motion, the Ordinance was no longer put back on the agenda for the reconsideration of the Legislative Council's opinion”, explained the Government's spokeswoman, Ioana Dogioiu, to HotNews.
What the Ordinance of Bolojan provided
The ordinance was adopted by the government on Tuesday, one hour before the Parliament session in which the Bolojan Government was dismissed.
“I said that I would not leave this government until this morning I came up with an ordinance to impose firm guarantees. You probably thought that if you move quickly with the motion, we can no longer correct what needed to be corrected. And maybe you don't know who is the director of Transelectrica”, said Bolojan, in the speech given later in the plenary session in which the censure motion was voted.
Through the new regulations in the GEO, a guarantee of 30 euros per installed kilowatt was established, which must be established at the time of requesting the establishment authorization, as a condition for obtaining it.
“The additions to the emergency ordinance were motivated by the importance and urgency of the regulations, combined with the possibility that in the event of the vote of censure against the executive, it will no longer be able to issue emergency ordinances during the interim period,” said the Government.
The provisions had to be approved by ANRE
These articles should have been approved by ANRE, which has had in public debate since the beginning of March a draft regulation on increasing guarantees for connection to the electricity network.
In the initial form of the ANRE project, an increase in the guarantee for connection was foreseen from 5% to 20% of the value of the connection tariff. Ilie Bolojan asked for higher guarantees and thus the Government came up with proposals to modify the ANRE project.
On April 27, the new form of the project was published on the ANRE website, but it was not approved until Tuesday when they were adopted by the Government.
Transelectrica is the state company that grants technical approvals for connection. The company's directorate is headed by Ștefăniță Munteanu. This is the director Ilie Bolojan referred to. Munteanu was a county councilor in Buzău from the PSD, close to Prime Minister Marcel Ciolacu and his nephew, Mihai Ciolacu, according to Bursa Newspaper, which writes that Ștefăniță Munteanu is Marcel Ciolacu's son.
The Prime Minister has said on several occasions that these “clever guys” are obtaining documentation and technical approvals for connections (ATR) for investments that they do not intend to make, but only to sell.
