Former CCR judge Petre Lăzăroiu explains to what extent it would be possible for Ilie Bolojan to be appointed prime minister again

The former constitutional judge Petre Lăzăroiu commented on the scenario circulated within the PNL according to which Ilie Bolojan could again be proposed for the position of prime minister, an idea publicly advanced by the leader of the liberal deputies, Gabriel Andronache, who invoked a decision of the Constitutional Court from 2020.

Lăzăroiu stated to Digi 24 that the constitutional court has ruled several times on this issue:

“The CCR ruled not only in 2020 and even before 2020. You see, the Court took into account a reality, in actual reality: the moment a prime minister is dismissed by a motion of no confidence, it is hard to imagine that the same prime minister will be lucky in a new nomination. That's why the court said: don't come with the same prime minister again“.

“It wouldn't be the first time that decisions are not respected”

The former judge of the CCR, however, added that, in practice, the decisions of the CCR are not always respected.

“As our constitution is applied as one or the other wants, you don't have any kind of problem. The president will nominate. The point is that he nominates and he will probably fail again at the vote, because the way things have turned out, it is obvious that he no longer has support”explained the former judge/

Petre Lăzăroiu emphasized that the precedent of non-compliance with CCR decisions already exists:

“It wouldn't be the first time that decisions are not respected, even those that were, how can I say, abrupt. I clearly said yes or no and they still weren't respected. What can we expect now?

The former judge explained that, “according to the letter of the law, the president should appoint another person to coagulate a majority and interest in the position of prime minister”.

We remind you that the former constitutional judge Tudorel Toader claims that a possible reappointment of Ilie Bolojan for the position of prime minister, after a no-confidence motion, could violate the logic of the decisions of the Constitutional Court and the will of the Parliament.

Gabriel Andronache: “Ilie Bolojan can be appointed prime minister again”

The leader of the PNL deputies, Gabriel Andronache, said on Thursday, May 7, that Ilie Bolojan could be appointed prime minister again, even if the government led by him fell through a no-confidence motion

“Ilie Bolojan can be appointed prime minister again. The decision of the Constitutional Court in 2020 is very clear. The prime minister dismissed by a motion of censure can be appointed again to form the Government, if: The President of Romania does not seek to provoke early elections, by appointing the same candidate (former prime minister). We are not in this scenario. Condition fulfilled”wrote Gabriel Andronache on Facebook.

According to him, another condition is the coagulation, by the designated candidate, of a new parliamentary majority that is not formed by the same parties that formed the majority before the censure motion.

Andronache says it takes ca the nomination of the same candidate not to be immediate to the censure motion, ie to pass a reasonable period of time from the date of the censure motion, “in which the Parliament's opinion can be changed regarding the former Prime Minister”.
