After 14 years of court battle, the city reached a settlement with the developer and paid almost PLN 50 million for the water supply, sewage and rainwater drainage systems in Miasteczko Wilanów.

At the end of the 1990s, the Warsaw University of Life Sciences sold land in Wilanów. The then Wilanów commune had the right of pre-emption. Ultimately, she gave up this right in favor of Prokom. The entities signed an agreement in which Prokom agreed to provide the city with the water supply and sewage infrastructure it had built for free.

Prokom, and then its related company Polnord, built such a network, and Miasteczko Wilanów was built on the purchased land. It was then that the dispute between the parties began over the issue of payment for infrastructure.

“The legal successors of the original builders, including Polnord and Prokom, began to question the arrangements, demanding payment both for the devices themselves and for the years of using them by the municipal company without a valid contract. This led to the initiation of a number of lawsuits, the oldest of which lasted continuously for almost fourteen years,” explained Jolanta Maliszewska, spokeswoman for the Municipal Water and Sewage Company.

In the course of various proceedings, the developer demanded amounts from the city, which together with accrued interest exceeded PLN 183 million. The ultimately negotiated settlement amount is less than PLN 50 million.

“This means that the city satisfied all claims for approximately 27% of the amount that was the subject of the court dispute. This is a huge saving, considering that each subsequent day of continuing the proceedings generated PLN 2,000 in interest alone,” Maliszewska emphasized.

Thus, the city became the owner of the pipes and water and sewage installations. According to MPWiK valuations, their total gross value is over PLN 138 million. This amount includes approximately PLN 65.6 million for the water supply and sewage network and nearly PLN 72.8 million for the rainwater drainage infrastructure.

“This means that for less than PLN 50 million, the capital not only gets rid of claims, but also takes over infrastructure worth almost three times as much,” noted the MPWiK spokeswoman.

She added that thanks to the settlement, legal issues regarding urban land with an area of ​​over 98,000 square meters were also settled. square meters. These are areas constituting key communication routes of Miasteczko Wilanów, such as Klimczaka Street, Oś Królewska, Sarmacka Street and Kieślowskiego Street.

The agreement also results in the developer waiving the compensation claims for the land specified in the settlement. The value of these claims, according to the developer's valuations, is almost PLN 85 million. “The waiver of these claims and the commitment not to pursue them in the future is a huge relief for Warsaw, which effectively removes the specter of further costly lawsuits over land under the most important streets of the district from the city,” Maliszewska explained.

She noted that thanks to the MPWiK settlement, the municipal company can now freely plan modernizations, repair failures and issue decisions on connecting new users, without regard to the developer's consent or evidentiary proceedings that last for years.

She added that the conclusion of the agreement opens the way to regulating the condition of further properties intended for public purposes, including sports and recreation areas, and in particular Wilanów Beach. (PAP)
