The former presidential candidate Călin Georgescu is, on Tuesday, in front of the judges of the High Court of Cassation and Justice, who will decide whether the file goes back to the Prosecutor's Office or can start the trial on the merits in the trial in which he is accused, along with Horatiu Potra, of actions against the constitutional order.

Georgescu was awaited at the supreme court by dozens of supporters with tricolor flags, who chanted: “Călin, we love you!”, writes News.ro.

The judges of the supreme court are expected to decide definitively whether the trial on the merits can begin in the file of the General Prosecutor's Office in which 22 defendants are accused of actions against the constitutional order. Among them is Călin Georgescu, the mercenary Horaţiu Potra, his son and grandson. On April 2, the Bucharest Court of Appeal decided that the trial can begin, but the decision is not final and was appealed to the ICCJ.

Prosecutors' accusations in the case of Călin Georgescu and Horațiu Potra's mercenaries

In this case, Călin Georgescu, who won the first round of the presidential elections in 2024, then annulled by the CCR, was sent to court in September 2025, for the crimes of complicity in the attempt to commit actions against the constitutional order and the communication of false information, in continuous form.

Also, Horațiu Potra, the leader of the Romanian mercenaries who fought in the Congo, is accused of attempting to commit actions against the constitutional order, non-compliance with the arms and ammunition regime, non-compliance with the explosives regime and public incitement. Potra is currently in pre-trial detention.

Potra's son and grandson and 18 other people who are accused of being part of the plan led by Horațiu Potra at the end of 2024, following the annulment of the results of the first round of the presidential elections, are also on trial.

Horațiu Potra was caught and arrested on September 24, 2025 at Dubai airport, after fleeing the country, together with his son and grandson. They were caught just before boarding a flight to Moscow. Potra was brought into the country two months later.

According to the prosecutors, Georgescu and Potra met on December 7, 2024, one day after the Constitutional Court decided to cancel the presidential elections, in Ciolpani, Ilfove, where they discussed a plan according to which Potra and his mercenaries, with military training, were going to create chaos in Bucharest.

Călin Georgescu is identified in the investigation as the moral author of the entire plan to take over the levers of power.

“The defendants Georgescu Călin and Potra Horatiu discussed a plan according to which the latter, together with people from his relational circle, with military training or operational capabilities specific to military training, were to carry out on December 8, 2024 in the city of Bucharest, in the context of protest actions, subversive violent actions, with the role of hijacking the peaceful nature of protest actions in demonstrations characterized by violence, the strategy pursuing, through emotional and behavioral contagion doubled by the manipulation of collective emotions, in the context of a moment of maximum social tension, the change of the constitutional order or the making difficult or preventing the exercise of state power”, accuse the investigators.

As a result of the established plan, Horațiu Potra organized/coagulated a group of paramilitaries of 21 people, led by him, and as part of it, it was decided to travel to the city of Bucharest with 7 cars, following that, after arriving in the Capital, its members would launch protests against the bodies that exercise state authority, able to attract the engagement and broad support of the population. They were stopped before reaching Bucharest.

This case is now with the District Judge 1. The next term is scheduled for April 28.
