“Dropper” from Kuzbass will pay about 900 thousand rubles to a pensioner from Krasnoyarsk

The loss of a bank card brought a student from Kuzbass to court – he became a defendant in a lawsuit for a large sum.

As follows from the materials of the civil case, in February 2024, a 75-year-old resident of Krasnoyarsk received a call from an unknown person. During telephone conversations, the attacker convinced the pensioner to transfer 845 thousand rubles to a bank account. After some time, she realized that she had become a victim of a criminal scheme and filed a complaint with law enforcement agencies.

Krasnoyarsk investigators found that the bank account to which the money was deposited belongs to a young resident of Kuzbass Mariinsk. The prosecutor of the Central District of Krasnoyarsk filed an application with the Mariinsky City Court to recover the amount of unjust enrichment from the “dropper”. The 21-year-old guy and his representative at the court hearing objected to the satisfaction of the claims.

The young man’s lawyer explained that his client could not use the pensioner’s money, since he was in Kuzbass when unknown persons cashed out her funds in Novosibirsk. The guy also added that while studying at a technical school, he learned from a friend about the shares of one of the banks. The student followed the example of his friend: he ordered a bank card, told his friends about it and received 500 rubles as a bonus, but later lost the “plastic”.

“Based on the rules for issuing and servicing bank cards, the card is the property of the bank and is issued to the owner for temporary use. Transferring the card to third parties and providing information about PIN codes is strictly prohibited by the terms of the agreement. The owner bears personal responsibility for transactions with the card. Thus, when transferring a bank card to other persons, all negative consequences of completed financial transactions are assigned to the person in whose name the bank card was issued,” reads the information on the website of the Mariinsky City Court.

As a result, they decided to collect 900 thousand rubles from the young man in favor of the defrauded pensioner; this included both unjust enrichment and interest on the use of other people’s money. At the same time, the student will be required to pay a state fee of about 23 thousand rubles to the budget of the Mariinsky Municipal District of Kuzbass.

The verdict has not yet entered into legal force.
