March 25 8:11
A resident of Krasnoyarsk was able to sue for compensation for moral damages for causing bodily injuries during a collision on the ski slope in the Bobrovy Log Funpark.
A woman was skiing down the slopes and another skier crashed into her, who neglected safety precautions. The victim decided to hold the other party accountable and filed a lawsuit.
“The court, having analyzed the evidence presented and established the circumstances of the incident, came to the conclusion that the defendant’s fault lies in the fact that, having approached the plaintiff and being higher up the slope, she did not choose the speed and direction of movement of the descent from the mountain that was safe for the skier located below on the slope, did not maintain a distance sufficient for any intentional or unintentional movements of the plaintiff, and allowed a collision that led to harm to the plaintiff’s health, physical and moral suffering,” the department said.
The Sverdlovsk District Court satisfied the demands of Krasnoyarsk and recovered from the defendant compensation for moral damage in the amount of 300,000 rubles.
