In the Krasnoyarsk Territory, bailiffs achieved full payment of compensation for moral damage in favor of an injured pedestrian who was hit by a drunken pensioner.
According to the press service of the GUFSSP for the region, the accident occurred in Nazarovo. An elderly woman got behind the wheel of a car while intoxicated. Driving to the side of the road, she ran over a man. As a result of the accident, the victim suffered serious harm to his health. Doctors diagnosed him with an open fracture of the lower leg bones with displacement and nerve damage.
Having considered the case materials, the court decided to recover compensation for moral damages from the pensioner in the amount of 825 thousand rubles. The writ of execution was received by the bailiff department in the Nazarovsky district. However, despite the court's decision, the woman was in no hurry to voluntarily pay compensation to the injured man. She was charged an enforcement fee in the amount of 58 thousand rubles for failure to comply with the demands of the bailiff, and the total amount of the debt approached 900 thousand rubles.
As a result, the debtor's bank accounts were seized. Money was systematically written off from her pension payments, but this was not enough to fully repay the debt. The car in which the accident was committed was pledged to the bank, which made it impossible to seize it for subsequent sale.
“In order to execute the court decision, the bailiffs issued a ruling banning registration actions in relation to the debtor’s apartment. Also, during the enforcement actions, a garage belonging to the woman was seized. The property was valued at 200 thousand rubles and transferred for sale. Only when the debtor realized the real prospect of losing the property, she found the necessary funds and paid the debt in full, including the enforcement fee,” the department said.
To date, the entire amount of compensation has been transferred to the victim, and restrictions on the debtor’s property have been lifted.
