Specialists from Rospotrebnadzor in the Krasnoyarsk Territory helped the consumer return almost 200 thousand rubles for the imposed services.
The press service of the department said that the man faced pressure from banks when buying a car on credit. Under the pretext of “improving conditions” and “mandatory requirements,” additional services were imposed on him. As a result, when applying for a consumer loan, he was forced to agree to an insurance package for several insurance programs from the bank itself for 12,999 rubles and an insurance policy from another company in the amount of 178,650 rubles. At the same time, the entire cost was not paid separately, but was included in the “body” of the loan, increasing its amount and future overpayments.
Realizing the financial burden, the man decided to refuse unnecessary insurance, but was refused. Then the victim contacted Rospotrebnadzor. The department's specialists helped to draw up written claims for termination of insurance contracts and refund of money.
After receiving official complaints, the contracts were terminated. The man was returned 191,649 rubles.
“In accordance with Art. 782 of the Civil Code of the Russian Federation and Article 32 of the Law of the Russian Federation of 02/07/1992 No. 2300-1 “On the Protection of Consumer Rights,” the consumer has the right to refuse the service unilaterally. Also, according to the Directives of the Bank of Russia dated August 21, 2017 No. 4500-U, if the policyholder refuses the voluntary insurance contract within fourteen calendar days from the date of its conclusion, regardless of the moment of payment of the insurance premium, in the absence of events in this period that have signs of an insured event, the insurance premium is returned to him in full,” Rospotrebnadzor recalled.
