In Zelenogorsk, a former administration employee illegally helped her daughter get a municipal apartment.

The press service of the Prosecutor's Office of the Krasnoyarsk Territory reported that in December 2022, the chief legal adviser of the Zelenogorsk administration with 13 years of legal experience herself violated the law.

Her daughter filed a lawsuit against the municipality to recognize the ownership of her deceased stepfather's apartment. At the same time, the property, after the refusal of the only heir, his own daughter, was subject to transfer to the ownership of the municipality as escheat.

“Knowing this, the plaintiff’s mother not only did not notify about the conflict of interest, but also represented both parties at the court hearing. In fact, she acted against the interests of the city, facilitating the illegal alienation of a municipal apartment worth almost 880 thousand rubles. Despite the obvious violation, the head of the administration fired the legal adviser not “due to loss of confidence,” but of his own free will. The prosecutor’s office did not agree with this and went to court,” the supervisory agency said.

The trial court decided that the lawyer, representing both sides, simply exercised her constitutional right to judicial protection. As a result, her action was assessed not from the point of view of anti-corruption legislation, but as the actions of an official. This completely misrepresented the conflict of interest.

The Court of Appeal overturned the previous decision and agreed with the position of the prosecutor's office. The administration's inaction was declared illegal, and the principles of official ethics were returned to their place.

The execution of the court decision is under the control of the prosecutor's office.
